A BILL FOR AN ACT

 

 

relating to air pollution control.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 342B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§342B-    Filters for mercury particles in crematoriums required.  Beginning January 1, 2015, it shall be unlawful for any crematorium to operate within the State without an appropriate filter to capture mercury particles from emissions prior to release into the air."

     SECTION 2.  Section 342B-35, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§342B-35[]]  Crematoriums.  Crematoriums of human remains operating within the State shall be subject to the permit requirements of this chapter; provided that [the]:

     (1)  The owners or operators of any crematoriums constructed before March 20, 1972, and operating within the State without a permit shall submit permit applications to the department no later than December 31, 2013[.]; and

     (2)  Beginning January 1, 2015, no permit shall be issued for any crematorium that is not equipped with an appropriate filter to capture mercury particles from emissions prior to release into the air."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2014.
