A BILL FOR AN ACT

 

 

relating to sexual offenses against minors.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 712, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§712-     Prohibition on presence of certain sex offenders near school property.  (1)  It shall be unlawful for any person convicted of a sexual offense against a minor to be present in or loiter within            feet of any school building or any real property comprising a school; provided that:

     (a)  A student who is enrolled at a particular school shall not be prohibited from being present in or loitering within            feet of the school at which the student is enrolled;

     (b)  A person who is a lawfully registered and qualified voter shall be permitted to be present on school property for the sole purpose of casting a vote;

     (c)  A parent, legal guardian, or custodian of a child enrolled at a particular school may be permitted to be present or loiter within            feet of the school at which the child is enrolled if the parent, legal guardian, or custodian:

         (i)  Has permission from the superintendent or board of education; provided that the superintendent or board has notified the school principal, in the case of a public school; or

        (ii)  Has permission from the principal, in the case of a private school.

     (2)  As used in this section:

     "School" means any public, charter, or private preschool, kindergarten, elementary, intermediate, secondary, or high school.

     "Sexual offense" shall have the same meaning as in section 846E-1.

     (3)  Any person who violates this section shall be guilty of a misdemeanor."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
