A BILL FOR AN ACT

 

 

RELATING TO GOVERNMENT ACCOUNTABILITY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 103D-1202, Hawaii Revised Statutes, is amended to read as follows:

     "§103D-1202  Rules.  The policy board shall adopt rules in accordance with chapter 91 governing:

     (1)  The management of properties during their entire life cycle;

     (2)  The classes of property, whether expendable or nonexpendable;

     (3)  The action to be taken [in case] when issues of lost, stolen, damaged, unserviceable, or unsuitable property[;] arise, including:

         (A)  A maximum time limit within which all issues shall be reported between a governmental body and contractor; and

         (B)  A duty for a governmental body and a contractor to cooperate in the investigation of raised issues;

     (4)  The sale, lease, trade-in, or disposal of surplus property by public auction, competitive sealed bidding, or other appropriate method designated by rules; provided that no employee of the owning or disposing agency shall be entitled to purchase this property; and

     (5)  The transfer of excess property."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2112.

Government Accountability; Procurement Policy Board; Government Contracts

 

Description:

Expands the Procurement Policy Board's mandate to adopt rules regarding lost, stolen, damaged, unserviceable, or unsuitable property to include time limits for reporting issues and a duty for government agencies and contractors to cooperate in the investigation of raised issues.  Effective July 1, 2112.  (HB2621 HD2)
