RELATING TO TOBACCO REGULATION.

Increases the license fee for persons engaged as a wholesaler or dealer of cigarettes or tobacco products.  Increases the retail tobacco permit fee for retailers engaged in the retail sale of cigarettes and other tobacco products.

RELATING TO THE HURRICANE RESERVE TRUST FUND.

Requires the interest and other moneys earned on the principal of the hurricane reserve trust fund to be deposited into the trust fund instead of being diverted to the general fund.

RELATING TO MORTGAGE RESCUE FRAUD.

Clarifies definition of "distressed property consultant" and specifies that attorneys must be licensed by, and engaged in the practice of law in, the State of Hawaii in order to fall within the class of exceptions to the definition of "distressed property consultant".

RELATING TO SECURE AND FAIR ENFORCEMENT FOR MORTGAGE LICENSING ACT.

Adds definitions for clarity.  Requires a mortgage loan originator company to be open during specified regular business hours to the public and for examination or investigation by the commissioner.  Deletes exemptions for individuals facilitating mortgage loans for their family members and family property.  Clarifies that a branch manager may not oversee more than one branch office or principal place of business.  Excludes certain information included in NMLS from confidentiality provisions of the law.

RELATING TO ADMINISTRATIVE PROCEDURE.

For agency failure to act within established time periods on applications for business and development-related permits and licenses, repeals provisions that require automatic application approval or require an application to be deemed complete.

RELATING TO THE UNIFORM POWER OF ATTORNEY ACT.

Establishes the Uniform Power of Attorney Act.  Defines the levels of authority granted in a power of attorney to the principal's agent.  Requires the agent to act in good faith and within the scope of authority granted in the power of attorney.  Provides sample documents to be used to create a statutory form power of attorney.  Repeals Chapter 551D, Hawaii Revised Statutes.

RELATING TO WAGES AND HOURS ON PUBLIC WORKS.

Extends the suspension period from three to five years for a third violation of a person or firm who fails to pay the prevailing wage under a public work contract.

RELATING TO UNLICENSED CONTRACTOR FRAUD.

Specifies that, for purposes of the offense of unlicensed contractor fraud, the "intent to deprive" may be formed before or after the person obtains or exerts control over the property of another.

RELATING TO CHARITABLE SOLICITATION.

Requires certain disclosures on collection boxes for donated clothing and household items by for-profit and nonprofit organizations; clarifies registration requirement for Hawaii domiciled charitable organizations and by nonprofits covered by an IRS Group Exemption Ruling; authorizes the Attorney General to require electronic financial reporting by professional solicitors, imposes a late fee for late financial reports by professional solicitors; clarifies that commercial co-venturers must provide a final accounting within thirty days; clarifies exemptions from registration requirements; and makes other technical and housekeeping amendments to chapter 467B, Hawaii Revised Statutes.

      Status & Testimony

RELATING TO CONDOMINIUMS.

Requires condominium board members and managing agents to disclose potential conflicts of interest in the awarding of contracts.  Requires annual report on complaints and enforcement actions.  Grants the real estate commission enforcement powers over issues relating to the management of condominiums.
