MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF HEALTH FOR THE DEVELOPMENTAL DISABILITIES DIVISION.

Authorizes an emergency appropriation for FY 2013-2014 from general funds to the Department of Health, for ongoing services provided by the developmental disabilities division to the Compact of Free Association population that is eligible for those services.  (SD1)

RELATING TO THE COLORECTAL CANCER SCREENING PILOT PROGRAM.

Establishes a Hawaii colorectal cancer screening awareness pilot program using the Hawaii comprehensive breast and cervical cancer control program as a model.  Appropriates funds for the first year of the pilot program.  Effective 07/01/2050.  Repeals on 06/30/2016.  (SD2)

RELATING TO INSURANCE.

Prohibits rescission of coverage under health benefit plans in most circumstances; requires written notice prior to rescission.  Clarifies a requirement with regard to companies with general casualty insurance authority.  Clarifies retention requirements for tax records for surplus line brokers and independently procured insureds.  Allows the insurance fraud investigations branch to take appropriate action in certain instances.  Includes long-term care insurance as part of limited benefit health insurance.  Amends definitions relating to captive insurance companies.  Specifies certain rate making requirements for managed care plans.  Makes other amendments to conform to National Association of Insurance Commissioners model laws and the federal Patient Protection and Affordable Care Act.  Effective 7/1/2050.  (SD2)

Authorizes the Insurance Commissioner to collect and publish health premium information.

RELATING TO TELEHEALTH.

Requires reimbursement for services provided through telehealth to be equivalent to reimbursement for the same services provided via face-to-face contact between a health care provider and a patient.  Clarifies that a health care provider of telehealth includes primary care providers, mental health providers, and oral health providers, such as physicians and osteopathic physicians, advanced practice registered nurses, psychologists, and dentists.  Amends references to "telemedicine" in the Hawaii Revised Statutes to "telehealth" for consistency.  (SD2)

RELATING TO OCCUPATIONAL THERAPY PRACTICE.

Improves the regulation of occupational therapists and occupational therapy assistants by establishing an occupational therapy program and licensing requirements for occupational therapists and occupational therapy assistants.  Makes an appropriation.  Effective 7/1/2050.  (SD2)

RELATING TO CONTINUING EDUCATION FOR PSYCHOLOGISTS.

Requires psychologists in the State of Hawaii to complete a minimum of 18 credit hours of continuing education courses during each licensing renewal biennium, beginning 07/01/2016.  Effective 07/01/2050.  (SD2)

Status

RELATING TO CONTINUING COMPETENCY FOR NURSES.

Requires licensed registered nurses and licensed practical nurses to submit evidence of continuing competency at each renewal period, beginning with the June 30, 2017, licensing biennium.  Requires the department of commerce and consumer affairs, in collaboration with the center for nursing, to convene a stakeholder group to address any outstanding issues associated with the implementation of the continuing competence requirements for nurses and report to the legislature.  (SD2)

Status

RELATING TO THE BOARD OF DENTISTRY AND DENTAL HYGIENE.

Changes the name of the board of dental examiners to "board of dentistry and dental hygiene".  Beginning 07/01/2015:  increases the number of members on the board from twelve to thirteen members; requires three members to be licensed, practicing dental hygienists; and requires at least one of the practicing dentist members to be a practicing dentist with a background in public health dentistry or a license in community service dentistry.  Requires the board of dentistry and dental hygiene to develop conflict of interest policies relating to dental examination companies and report back to the legislature prior to the regular session of 2015.  Effective 07/01/2050.  (SD1)

RELATING TO HEALTH.

Requires vendors who have been awarded contracts through the Centers for Medicare and Medicaid Services durable medical equipment, prosthetics, orthotics, and supplies bidding program to have a physical presence in Hawaii.  Effective 7/1/2050.  (SD2)

RELATING TO PROVIDER ORDERS FOR LIFE-SUSTAINING TREATMENT.

Increases access to POLST by updating references from "physician orders for life-sustaining treatment" to "provider orders for life-sustaining treatment" throughout chapter 327K, HRS; expanding health care provider signatory authority to include advanced practice registered nurses; and correcting inconsistencies over terms used to describe who may sign a POLST form on behalf of a patient.

Status

RELATING TO ELECTRONIC SMOKING DEVICES.

Includes electronic smoking devices within the definition of "tobacco products" under chapter 245, Hawaii Revised Statutes, thereby subjecting wholesalers, dealers, and retailers of electronic smoking devices to the same licensing and permitting requirements as wholesalers, dealers, and retailers of cigarettes and other tobacco products.  Establishes an excise tax on electronic smoking devices equal to an unspecified per cent of the wholesale price of each electronic smoking device kit, electronic smoking device nicotine cartridge, or electronic smoking device nicotine refill sold, used, or possessed by a wholesaler or dealer on or after October 1, 2014.  Amends Hawaii's anti-smoking statute to prohibit the use of electronic smoking devices in places open to the public and places of employment.  License and permit requirements for wholesalers, dealers, and retailers of electronic smoking devices and excise tax effective 1/1/2015.  Effective 7/1/2050.  (SD3)

                Electronic testimony will be accepted until the start of the hearing.

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.
