A BILL FOR AN ACT

 

 

relating to ALBIZIA TREES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that albizia trees are an invasive species that present a threat to life and property in Hawaii.  The speed and manner in which albizia trees grow is harmful to native biota and presents a biosecurity threat to Hawaii's native wildlife.  The invasive species council has identified albizia trees as a priority concern for their potential threat to human safety and the environment.  The legislature also finds that the removal of invasive albizia trees is a biosecurity and eradication program as contemplated by section 150A-4.5, Hawaii Revised Statutes, and warrants the use of moneys in the pest inspection, quarantine, and eradication fund for that purpose.

     The purpose of this Act is to appropriate moneys from the pest inspection, quarantine, and eradication fund to the department of agriculture for the removal of albizia trees on public and private land.

     SECTION 2.  There is appropriated out of the pest inspection, quarantine, and eradication fund the sum of $           or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 for the removal of albizia trees on public and private land.

     The sums appropriated shall be expended by the department of agriculture for the purposes of this Act; provided that no state moneys shall be expended under this Act for the removal of albizia trees on private land unless matched on a dollar-for-dollar basis by private moneys.

     SECTION 3.  This Act shall take effect on July 1, 2015.
