A BILL FOR AN ACT

 

 

relating to attorneys.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 605-1, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  In order to be licensed by the supreme court, a person shall be of good moral character, and shall satisfy such residence and other requirements as the supreme court may prescribe[.]; provided that no person shall be required to join any private organization as a requirement for licensure."

     SECTION 2.  Section 605-15.1, Hawaii Revised Statutes, is amended to read as follows:

     "§605-15.1  Standing.  The attorney general or [any bar association] a disciplinary body authorized by the supreme court in this State may maintain an action for violations of section 605-14."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.


     SECTION 4.  This Act shall take effect upon its approval.

Attorney Qualifications; Disciplinary Board

 

Description:

Establishes that there is no requirement for an attorney to join any association or organization of lawyers to maintain a law license in this State.  Authorizes a disciplinary body authorized by the supreme court, rather than a bar association, and maintain actions for the unauthorized practice of law.
