A BILL FOR AN ACT

 

 

RELATING TO CYBERSECURITY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the economic viability of Hawaii rests upon the State's ability to monitor, detect, and defend its critical infrastructure from cyber-attacks.  The quantity and sophistication of cyber events, as well as the variety of attacks, will continue to evolve and grow exponentially in the years to come.  Implementing effective cybersecurity measures will also be a constantly evolving challenge.  Therefore, it is of critical importance for the State to establish a full-time Hawaii cybersecurity, economic, education, and infrastructure security coordinator to continuously assess and synchronize all efforts within the State to properly and robustly develop and prioritize the resources necessary to build the State's cybersecurity.

     The purpose of this Act is to strengthen Hawaii's cybersecurity by:

     (1)  Reducing restrictions on the hiring and employment of the Hawaii cybersecurity, economic, education, and infrastructure security coordinator;

     (2)  Authorizing the coordinator to employ a secretary; and

     (3)  Appropriating funds for the coordinator and secretary positions.

     SECTION 2.  Section 128B-1, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  There is established, without regard to chapter 76, the full-time Hawaii cybersecurity, economic, education, and infrastructure security coordinator to oversee cybersecurity and cyber resiliency matters, including cybersecurity, economic, education, and infrastructure security for the State.  The coordinator may employ one secretary who shall generally assist the coordinator.  The coordinator shall be placed within the state department of defense."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 for the hiring of the Hawaii cybersecurity, economic, education, and infrastructure security coordinator and one secretary to assist the Hawaii cybersecurity, economic, education, and infrastructure security coordinator.

     The sums appropriated shall be expended by the office of homeland security for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2015.
