A BILL FOR AN ACT

 

 

proposing an amendment to article ii of the constitution of the state of hawaii to impose resign-to-run.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


          SECTION 1.  The purpose of this Act is to propose an amendment to article II, section 7, of the Constitution of the State of Hawaii to impose resign-to-run on all state and federal public office.

     SECTION 2.  Article 2, section 7, of the Constitution of the State of Hawaii is amended to read as follows:

     "RESIGNATION FROM PUBLIC OFFICE

     Section 7.  Any city, county, or state elected public officer shall resign from that office before being eligible as a candidate for [another]any state, or federal public office, if the term of the office sought begins before the end of the term of the office held. [Add Const Con 1978 and election Nov 7, 1978]

    SECTION 3.  The question to be printed on the ballot shall be as follows:

    "Shall city, county, and state elected public officers be required to resign when running for a state or federal office that begins before the end of the term of the current office held?" 

     SECTION 4.  Constitutional material to be repealed is bracketed and stricken.  New constitutional material is underscored.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
