A BILL FOR AN ACT

 

 

relating to Colon hydrotherapy.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that colon hydrotherapy, also known as colonic irrigation, colon lavage, and colonic services, is potentially dangerous and could cause illness or injury if the person who performs such a service is not properly trained.  The legislature further finds that the board of examiners in naturopathy, now known as the board of naturopathic medicine, determined in 1990 and 2004 that colon hydrotherapy is within the scope of practice of a naturopathic physician.  The board in 1990 and 2004 also agreed that colon hydrotherapy should be performed by or under the supervision of a naturopathic physician, a consensus that was reached again in 2011.  The 2011 board noted that colon hydrotherapy needed to be performed by or under the supervision of a naturopathic physician only when performed on another person.

     The purpose of this Act is to clarify prior determinations of the board of naturopathic medicine, relating to colon hydrotherapy, by:

     (1)  Adding a definition for "colon hydrotherapy";

     (2)  Amending the definition of "naturopathic medicine" to include colon hydrotherapy; and

     (3)  Specifying that colon hydrotherapy shall be performed on another person only by or under the supervision of a naturopathic physician.

     SECTION 2.  Chapter 455, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§455-    Colon hydrotherapy.  Colon hydrotherapy shall be performed on another person only by or under the supervision of a naturopathic physician licensed pursuant to this chapter; provided that this section shall not be construed to prevent a licensed physician or advanced practice registered nurse from performing colon hydrotherapy that is otherwise authorized within that profession's scope of practice."

     SECTION 3.  Section 455-1, Hawaii Revised Statutes, is amended as follows:

     1.  By adding a new definition to be appropriately inserted and to read:

     ""Colon hydrotherapy" means a procedure that utilizes equipment approved by the Food and Drug Administration as a class II medical device to allow evacuation of the contents of the colon."

     2.  By amending the definition of "naturopathic medicine" to read:

     ""Naturopathic medicine" means the practice of the art and science of diagnosis, prevention, and treatment of disorders of the body by support, stimulation, or both, of the natural processes of the human body.  The practice of naturopathic medicine includes the prescription, administration, dispensing, and use of nutrition and food science, physical modalities, manual manipulation, parenteral therapy, minor office procedures, naturopathic formulary, hygiene and immunization, contraceptive devices, common diagnostic procedures, colon hydrotherapy, and behavioral medicine of the type taught in education and training at naturopathic medical colleges; provided that the use of parenteral therapy and performance of minor office procedures shall not be allowed until the board adopts rules in accordance with chapter 91 pursuant to section 455-6."

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
