A BILL FOR AN ACT

 

 

relating to medical marijuana.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 46-4, Hawaii Revised Statutes, is amended by amending subsection (f) to read as follows:

     "(f)  [Neither] Except as provided in this subsection, neither this section nor any other law, county ordinance, or rule shall prohibit the use of land for medical marijuana production centers or medical marijuana dispensaries established and licensed pursuant to chapter 329D; provided that the land is otherwise zoned for agriculture, manufacturing, or retail purposes[.]; provided further that each county may adopt criteria that the respective county council shall apply to evaluate potential locations for medical marijuana production centers and dispensaries; and provided further that a county council may prohibit medical marijuana production centers and dispensaries in a specified area based on the criteria established pursuant to this subsection.  Any criteria or prohibition on the siting of medical marijuana production centers or dispensaries established pursuant to this subsection shall be established by ordinance that is adopted unanimously upon final reading by the respective county council."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
