A BILL FOR AN ACT

 

 

relating to electronic benefits transfer cards.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to establish procedures to require a person to present photo identification when using an electronic benefits transfer card.

     SECTION 2.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-    Identification for electronic benefits transfer transactions.  The cardholder shall present photo identification to cashiers at food retailers, bank tellers, or other persons authorized to conduct point-of-sale transactions when making an electronic benefits transfer transaction.  If no photo identification is provided by the cardholder, the transaction may be declined."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2017.
