A BILL FOR AN ACT

 

 

relating to FACILITIES DEVELOPMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part VI, subpart A, to be appropriately designated and to read as follows:

     "§302A-     Lease of property.  (a)  Notwithstanding any law to the contrary, the board, without recourse to public auction or public notice for sealed bids, may lease real or personal property under the department's jurisdiction to any person, upon terms and conditions as may be approved by the board; provided that:

     (1)  The leased property shall be used for purposes of agriculture, public utilities, renewable energy, transit, or high technology development; and

     (2)  The board may enter into a leaseback transaction with the lessee. 

     (b)  For purposes of this section, "leaseback" means a transaction in which the board leases property to any person, pursuant to subsection (a), and thereafter subleases a portion of the same property or facilities thereupon from the lessee to carry out the purposes of this chapter."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
