MAKING APPROPRIATIONS FOR COLLECTIVE BARGAINING COST ITEMS.

To provide fund authorizations and appropriations for collective bargaining cost items for Unit (11) and their excluded counterparts, including the cost of salary adjustments negotiated between the State and the bargaining unit representative for fiscal biennium 2015‑2017.

      Status & Testimony

RELATING TO THE COLLECTION OF RESTITUTION FOR CRIME VICTIMS.

Creates standards and procedures for income-withholding for purposes of enforcing restitution orders.  Amends the definition of "debt" relating to the recovery of money owed to the State to include court-ordered restitution subject to civil enforcement.  Provides priority of income withholding orders.  Extends victims' access to adult probation records to include access to payment compliance records.  Requires that any bail posted by a defendant be applied toward payment of any court-ordered restitution in the same case.  Appropriates funds.

To re-appropriate $10,000,000 in general funds to the Emergency and Budget Reserve Fund for fiscal year 2015-2016.

PROPOSING AN AMENDMENT TO ARTICLE VII, SECTION 6, OF THE HAWAII CONSTITUTION, RELATING TO THE DISPOSITION OF EXCESS REVENUES.

Proposes a constitutional amendment to add alternatives for the disposition of excess general fund revenues.  Allows the appropriation of general funds for the pre-payment of general obligation bond debt service or pension or other post-employment benefit liabilities.

MAKING AN APPROPRIATION FOR THE ANNUAL REQUIRED CONTRIBUTION FOR THE HAWAII EMPLOYER-UNION HEALTH BENEFITS TRUST FUND.

Makes an appropriation for the payment of the annual required contribution for the Hawaii employer-union health benefits trust fund.

RELATING TO LIVESTOCK.

Adds deer to the list of animals included in the theft of livestock offense.

RELATING TO PROBATION.

Authorizes court to condition probation on requirement that a convicted defendant stay nightly in a homeless facility.  Clarifies that probation may be imposed for conviction of a county crime.  Appropriates moneys from the general fund for implementation.  Effective 01/01/17.

RELATING TO FANTASY COMPETITIONS.

Establishes fantasy competition as a violation of the gambling laws.  Provides an affirmative defense under limited situations.

RELATING TO FANTASY CONTESTS.

Provides for the authorization and regulation of fantasy contests.  Establishes consumer protections for participants.  Clarifies that fantasy contests shall not be considered gambling or games of chance.
