A BILL FOR AN ACT

 

 

relating to crosswalks.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established within the department of transportation a community crosswalks pilot program, which shall design and implement a specially painted crosswalk that represents a neighborhood's unique culture and promotes pedestrian safety.

     (b)  The department shall designate a crosswalk within the Waipahu school complex area to be used for the pilot program, provided that the crosswalk:

     (1)  Must be at a location that is already a marked crosswalk, and where a vehicle is required to stop, either due to a stop sign or traffic signal;

     (2)  To the extent possible, shall be located at an intersection with shorter width between streets and that experiences lower traffic volume; and

     (3)  Is located on pavement that is in good condition.

     (c)  The design of the crosswalk shall comply with the following guidelines:

     (1)  The crosswalk design must include two white horizontal markings with standard design and reflectivity to mark the edges of the crosswalk and ensure it meets minimum standards as required by state and county law;

     (2)  The crosswalk design must be fully contained within the two white horizontal markings;

     (3)  The design must use only horizontal or vertical stripes to ensure people driving, walking, and biking are aware that the specially painted crosswalk is an official crosswalk and is a designated place for people to cross;

     (4)  Colors for the crosswalk shall be approved by the department; and

     (5)  No text or logos, or octagons, triangles, or other symbols shall be used.

     (d)  Once a design is approved by the department, the department shall work in coordination with the department of transportation services of the city and county of Honolulu to apply the approved design to the designated crosswalk.

     (e)  There is established a community crosswalks special fund to be administered by the department of transportation for the purposes of this section, into which shall be deposited:

     (1)  All moneys appropriated by the legislature;

     (2)  Moneys withdrawn from the safe routes to school program special fund established under section 291C-4, Hawaii Revised Statutes; and

     (3)  Gifts and other private funds.

     The community crosswalks special fund shall be abolished on June 30, 2019, and all unencumbered balances shall lapse to the credit of the general fund.

     (f)  The department shall submit a report of its activities, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular sessions of 2018 and 2019.

     SECTION 2.  Section 291C-4, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  There is established in the state treasury the safe routes to school program special fund, into which shall be deposited:

     (1)  Assessments collected for speeding in a school zone, pursuant to section 291C-104; and

     (2)  Safe routes to school program surcharges collected in accordance with sections 291-16 and 291C-5.

Moneys in the fund shall be:

     (1)  [distributed] Distributed by the director of transportation to the respective counties to expend[.]; and

     (2)  Used for the community crosswalks pilot program established by Act    , Session Laws of Hawaii 2017."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 for deposit into the community crosswalks pilot program special fund established under section 1 of this Act.

     SECTION 4.  There is appropriated out of the safe routes to school program special fund established under section 291C-4, Hawaii Revised Statutes, the sum of $         or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 for deposit into the community crosswalks pilot program special fund established under section 1 of this Act.

     SECTION 5.  There is appropriated out of the community crosswalks pilot program special fund the sum of $         or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 for the purposes of the community crosswalk pilot program established by section 1 of this Act.

     The sums appropriated shall be expended by the department of transportation for the purposes of this Act.

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 7.  This Act shall take effect on July 1, 2017, and shall be repealed on June 30, 2019, provided that section 291C-4(a), Hawaii Revised Statutes, shall be reenacted in the form in which it read on the day prior to the effective date of this Act.
