A BILL FOR AN ACT

 

 

relating to condominiums.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

CONDOMINIUM DISPUTE RESOLUTION COMMISSION

     §   -1  Definitions.  As used in this chapter, unless the context otherwise requires:

     "Association" shall have the same meaning as that term is defined in section 514B-3.

     "Commission" means the condominium dispute resolution commission.

     "Department" means the department of commerce and consumer affairs.

     "Unit" shall have the same meaning as that term is defined in section 514B-3.

     §   -2  Condominium dispute resolution commission.  (a)  There is created a condominium dispute resolution commission within the department of commerce and consumer affairs for administrative purposes.  The commission shall consist of seven voting members who shall be citizens of the United States, shall have resided in the State for at least three years preceding appointment, and shall be appointed by the governor in accordance with section 26-34; provided that:

     (1)  Two members shall be unit owners who have resided in their unit for at least three years;

     (2)  Two members shall be members of an association board;

     (3)  One member shall be an attorney licensed to practice law in the State, preferably an attorney with real estate law experience;

     (4)  One member shall be a member of the real estate commission; and

     (5)  One member shall be a member of the public.

     The director of commerce and consumer affairs, or the director's designee shall be an ex officio, nonvoting member of the commission.

     Three members shall be appointed initially for a term of three years, two members shall be appointed for a term of two years, and two members shall be appointed for a term of one year.  Thereafter, the terms of office of each member shall be three years.  No member shall serve more than two, three-year terms of office.  Any vacancy in the commission shall be filled by appointment for the unexpired term.

     (b)  The members of the commission shall serve without pay but shall be reimbursed for their actual and necessary expenses, including travel expenses, incurred in carrying out their duties.

     (c)  Any action taken by the commission shall be approved by a simple majority of its members.  Four members shall constitute a quorum to do business.

     §   -3  Commission meetings.  (a)  The director of commerce and consumer affairs shall provide suitable quarters for meetings of the commission and for the transaction of its other business.

     (b)  The commission shall meet no less than four times each year to be held at times agreed upon by the members and at a place as provided by the director of commerce and consumer affairs under subsection (a); provided that a meeting may be called at any time by a simple majority of the members of the commission.

     (c)  All meetings of the commission shall be conducted in accordance with chapter 92.

     §   -4  Duties and powers of the commission.  The commission:

     (1)  Shall carry out those powers and duties otherwise conferred upon the real estate commission with regard to alternative dispute resolution under chapters 514A and 514B;

     (2)  Shall adopt, amend, or repeal rules as it may deem proper to effectuate this chapter and carry out its purpose.  All rules shall be approved by the governor and the director of commerce and consumer affairs, and when adopted pursuant to chapter 91 shall have the force and effect of law;

     (3)  Shall enforce this chapter and rules adopted pursuant thereto;

     (4)  Shall refer complaints regarding the alternative dispute resolution process or disputes between an association and unit owner to the commission ombudsman, receive reports and recommendations of action made by the commission ombudsman regarding a dispute, and consider the commission ombudsman's report and recommendation when making decisions considering the dispute;

     (5)  Shall report to the governor and the legislature relevant information regarding alternative dispute resolution under its jurisdiction, through the director of commerce and consumer affairs annually, and at other times and in other manners as the governor or the legislature may require concerning its activities;

     (6)  May publish and distribute pamphlets and circulars, produce seminars and workshops, hold meetings in all counties, and require other education regarding any information as is proper to further the accomplishment of the purpose of this chapter;

     (7)  May hire employees necessary to assist in the performance of its duties without regard to the requirements of chapter 76;

     (8)  May enter into contract or contracts with qualified persons to assist the commission in effectuating the purpose of this chapter; and

     (9)  May charge a fee to associations in accordance with section   -5.

     §   -5  Fees.  The commission may charge fees to cover the costs of the commission ombudsman established under section    -6; provided that the commission shall not charge more than $4.25 per unit belonging to the association.  All fees collected under this section shall be deposited into the condominium dispute resolution commission special fund.

     §   -6  Commission ombudsman; established; salary.  (a)  The commission, by a majority vote, shall appoint a commission ombudsman who shall serve for a period of five years and thereafter until a successor shall have been appointed.  A commission ombudsman may be reappointed but may not serve for more than two terms.  The commission, by a majority vote, may remove a commission ombudsman but only for neglect of duty, misconduct, or disability.  The commission ombudsman shall be hired without regard to chapter 76.  If the commission ombudsman dies, resigns, or is removed from office, the commission shall immediately appoint a new ombudsman for a full term.

     (b)  The salary of the commission ombudsman shall be established by the commission in consultation with the department of human resources development, but shall not exceed the salary of the deputy director of the department of commerce and consumer affairs.  The salary of the commission ombudsman shall be paid for from the condominium dispute resolution commission special fund.

     §   -7  Commission ombudsman; powers and duties.  The commission ombudsman:

     (1)  Shall receive and investigate any complaints regarding disputes between an association and a unit owner or any complaints referred to the ombudsman by the commission;

     (2)  May investigate on the ombudsman's own motion if the ombudsman reasonably believes that an appropriate subject for investigation exists;

     (3)  Shall establish procedures for receiving and processing complaints, conducting investigations, and reporting the ombudsman's findings.  However, the ombudsman may not levy fees for the submission or investigation of complaints;

     (4)  May make inquiries and obtain information as the ombudsman thinks fit in conducting an investigation;

     (5)  Shall maintain secrecy in respect to all matters and the identities of the complainants or witnesses except so far as disclosures may be necessary to enable the ombudsman to carry out the ombudsman's duties and to support the ombudsman's recommendations;

     (6)  Shall submit a report to the commission containing the findings of and recommendations for any investigation conducted;

     (7)  Shall submit to the governor, legislature and the commission an annual report discussing the ombudsman's activities under this chapter, including any actions taken and recommendations made by the ombudsman; and

     (8)  May hire any necessary staff without regard to chapter 76.

     §   -8  Commission ombudsman; notice to complainant and commission.  (a)  The commission ombudsman shall provide notice to the complainant and the commission upon initiation of an investigation.

     (b)  Upon completion of an investigation, the commission ombudsman shall notify the complainant and the commission and provide a report of the commission ombudsman's findings and recommendations to the complainant and commission.

     §   -9.  Condominium dispute resolution commission special fund.  (a)  There is established a condominium dispute resolution commission special fund into which shall be deposited any moneys appropriated to the fund by the legislature and any fees collected by the commission pursuant to section    -5.

     (b)  Moneys in the special fund shall be used for the salary of the commission ombudsman.  Any moneys in the special fund unencumbered for the salary of the commission ombudsman may be used by the commission or the ombudsman to carry out the purposes of this chapter, including hiring employees, specialists, and consultants necessary to assist in the performance of the commission's or commission ombudsman's duties.

     (c)  Moneys deposited into or appropriated to the special fund shall remain available until the moneys are obligated or until the special fund is terminated.

     (d)  If the special fund is terminated, all funds shall be transferred to the general fund; provided that all unexpended or unencumbered balances shall be disbursed in accordance with any requirements set by funding sources and for purposes consistent with this chapter.

     (e)  The commission shall submit an annual report on the status of the condominium dispute resolution commission special fund to the legislature, no later than twenty days prior to the convening of each regular session of the legislature.  The annual report shall include the total amount of moneys deposited to and distributed from the special fund, reasons and amounts for each distribution, and balances remaining on June 30 of each year."

     SECTION 2.  This Act shall take effect upon its approval.
