A BILL FOR AN ACT

 

 

relating to teacher salaries.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-    Teachers; salaries.  (a)  Notwithstanding any law to the contrary, the salaries for all department teachers shall be set according to the following schedule:

     (1)  Entry-level teachers shall be paid $60,000 per year;

     (2)  Mid-level teachers shall be paid $90,000 per year; and

     (3)  Senior-level teachers shall be paid $120,000 per year.

     (b)  The qualifications and classifications of entry-level teachers, mid-level teachers, and senior-level teachers shall be determined by the board of education by rule pursuant to chapter 91.

     (c)  Any department teacher who qualifies for a higher class shall be transferred to the higher class as of the beginning of the next semester and shall receive the salary of the higher class."

     SECTION 2.  Chapter 302D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302D-    Teachers; salaries.  (a)  Notwithstanding any law to the contrary, the salaries for all charter school teachers shall be set according to the following schedule:

     (1)  Entry-level teachers shall be paid $60,000 per year;

     (2)  Mid-level teachers shall be paid $90,000 per year; and

     (3)  Senior-level teachers shall be paid $120,000 per year.

     (b)  The qualifications and classifications of entry-level teachers, mid-level teachers, and senior-level teachers shall be determined by the board by rule pursuant to chapter 91.

     (c)  Any charter school teacher who qualifies for a higher class shall be transferred to the higher class as of the beginning of the next semester and shall receive the salary of the higher class."

     SECTION 3.  Section 89-9, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  [The] Except as provided in sections 302A-   and 302D-  , the employer and the exclusive representative shall meet at reasonable times, including meetings sufficiently in advance of the February 1 impasse date under section 89-11, and shall negotiate in good faith with respect to wages, hours, the amounts of contributions by the State and respective counties to the Hawaii employer-union health benefits trust fund to the extent allowed in subsection (e), and other terms and conditions of employment which are subject to collective bargaining and which are to be embodied in a written agreement as specified in section 89-10, but such obligation does not compel either party to agree to a proposal or make a concession."

     SECTION 4.  Section 302A-624, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  The salary schedule for all teachers of the department shall be [negotiated pursuant to section 89-9.] set according to section 302A-  ."

     SECTION 5.  Section 302D-25, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Charter schools shall be exempt from chapters 91 and 92 and all other state laws in conflict with this chapter, except those regarding:

     (1)  Collective bargaining under chapter 89, except as provided for under section 302D-  ; provided that:

         (A)  The exclusive representatives as defined in chapter 89 and the governing board of the charter school may enter into supplemental agreements that contain cost and noncost items to facilitate decentralized decision-making;

         (B)  The agreements shall be funded from the current allocation or other sources of revenue received by the charter school; provided that [collective bargaining] cost increases for employees shall be allocated by the department of budget and finance to the charter school's authorizer for distribution to the charter school; and

         (C)  These supplemental agreements may differ from the master contracts negotiated with the department;

     (2)  Discriminatory practices under section 378-2; and

     (3)  Health and safety requirements."

     SECTION 6.  Section 302A-628, Hawaii Revised Statutes, is repealed.

     ["[§302A-628]  Change in classification.  Any teacher who qualifies for a higher class shall be transferred to the higher class as of the beginning of the next semester and shall receive the salary at the appropriate step and range of the higher class."]

     SECTION 7.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 8.  This Act shall take effect on July 1, 2018.
