      Status & Testimony

RELATING TO AGRICULTURE.

Requires the department of agriculture to establish a two-year agricultural theft pilot project to focus on investigating and prosecuting agricultural theft or agricultural vandalism in the county of Hawaii.  Appropriates funds as a grant-in-aid to the office of the prosecuting attorney, county of Hawaii, to assist in implementing the pilot project.

      Status & Testimony

RELATING TO AGRICULTURE.

Establishes an industrial hemp special fund to carry out the purposes of the industrial hemp pilot program by the department of agriculture.  Requires each county to recognize the cultivation of industrial hemp for the purposes of the pilot program as an agricultural product, use, and activity.  Specifies that any agricultural land used for cultivation of industrial hemp for the purposes of the pilot program shall qualify for the minimum dedication period and be assessed at the lowest percentage of fair market value.  Limits the cultivation of industrial hemp to licensed owners, lessees, or occupiers of lands within the state agricultural land district.

RELATING TO POLYSTYRENE FOAM CONTAINERS.

Prohibits the use of polystyrene foam containers by food vendors beginning 1/1/18, unless: (1) the county in which the food vendor works has established a polystyrene foam container recycling program; or (2) DOH allows an exemption.

RELATING TO PUBLIC SAFETY.

Appropriates funds for a full-time agricultural management position and equipment for the Kulani correctional facility agriculture operation.

RELATING TO COUNTY ACCESS TO PRIVATE PROPERTY.

Authorizes the counties to enter private property to control or eradicate invasive species and pests.

RELATING TO AGRICULTURAL BUILDINGS.

Grants county agencies the implicit right to enter property to investigate agricultural buildings and structures for violations of and compliance with building code exemption qualifications.

RELATING TO AGRICULTURAL BUILDINGS.

Requires notice be given to certain county agencies at least 30 days prior to construction or installation of certain agricultural buildings and structures that are exempt from building permit and code requirements.  Imposes a fine of $100 per day of violation if construction or installation begins within 30 days of notice.

SB 1118

      Status & Testimony

RELATING TO AGRICULTURAL BUILDING PERMITS.

Removes exemptions from building codes and building permits for certain agricultural buildings and structures.  Requires each county to establish a list of agricultural buildings and structures that are exempt from building permit regulations no later than January 1, 2018.  Exempts specified buildings and structures, and their appurtenances, from certain building permit requirements.
