A BILL FOR AN ACT

 

 

relating to THE standing of legislative officers.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 634, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§634-    Standing of legislative officers.  The speaker of the house of representatives and the president of the senate, as agents of the State, shall jointly have standing to intervene on behalf of the legislature as a party in any judicial proceeding challenging the duties or authority of the legislature.  The procedure in state court shall be as set forth in Rule 24 of the Hawaii Rules of Civil Procedure."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
