A BILL FOR AN ACT
relating to hunting.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 183D, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:
"§183D- Hawaii
apprentice hunting license program; established. (a)
There is established the Hawaii apprentice hunting license program
within and administered by the department.
The purpose of the Hawaii apprentice hunting license program shall be to
provide licensees with information and training to assist the licensee to
qualify for a hunting license under section 183D-22; provided that the Hawaii
apprentice hunting license shall not be a requirement to qualify for a hunting
license under section 183D-22. The
Hawaii apprentice hunting license program shall not be used in place of the
hunting license issued under section 183D-22.
(b) A Hawaii apprentice hunting license shall be
issued by an agent of the department to a person:
(1) Who is at least
ten years of age;
(2) Upon completion
of a written application by the applicant, or if the applicant is a minor, by
the applicant's parent or legal guardian, in a form, prescribed by the
department, which shall include the following information:
(A) The
designation of a person who is at least twenty-one years of age and holds a
current and valid hunting license under section 183D-22, as a mentor for the
applicant; and
(B) A
statement under oath by the applicant, or if the applicant is a minor, by the
applicant's parent or legal guardian, of the applicant's name, address,
domicile or residence, length of residence in the State, age, race, height,
weight, and color of hair and eyes; and
(3) Upon payment of
a hunting license fee or any other hunting-related fee that the board may
require under this chapter; provided that the Hawaii apprentice hunting license
fee shall be $95; provided further that the fee shall be $10 for any person who
has resided in this State for more than one year or who is an active-duty
member of the armed forces of the United States.
(c) The Hawaii apprentice hunting license shall
be valid for the duration of the hunting season of the year in which the
license was issued. The license shall be
renewable for one additional year.
(d) A person who is issued a Hawaii apprentice
hunting license shall:
(1) Not permit any
other person to carry, display, or use the license in any way;
(2) Be in physical
possession of the license when hunting and show the license upon the demand of
any officer authorized to enforce the game laws of the State; and
(3) Be accompanied
by and under the supervision of the mentor named in the application as required
in subsection (b)(2)(A).
(e) Notwithstanding any provision to the contrary
in this chapter, while in the field:
(1) A mentor shall
not supervise more than two Hawaii apprentice hunting licensees at any one
time; and
(2) When a Hawaii apprentice hunting licensee uses a firearm in hunting, the mentor and the licensee shall possess not more than one firearm per person."
SECTION 2. Section 183D-21, Hawaii Revised Statutes, is amended to read as follows:
"§183D-21 Hunting licenses required. [No] Except as provided in
section 183D- , no person shall hunt, pursue, kill, or take any
game bird or mammal without first procuring a hunting license; provided that
section 183D-32 to the contrary notwithstanding, no license shall be required
of persons who may be authorized in writing by the board to destroy game birds
or game mammals injurious to forest growth or agriculture, or that constitute a
nuisance or a health hazard."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
