Exempts hospital services from the general excise tax for any private hospital; provided that a certain percentage or more of the annual patient population treated by the hospital consists of uninsured, medicaid, and medicare patients, and the hospital spends not less than a certain dollar amount for capital improvement projects at the hospital by a certain date. Requires reasonable suspicion and random drug testing of public school employees, teachers, and public library employees; requires department of education to adopt rules to determine sanctions for positive drug tests. Requires the department of education to develop procedures for obtaining the criminal history of certain persons who are seeking to serve as providers or subcontractors and trainees from an institution of higher education. Allows the department to pass on fees charged by the Hawaii criminal justice data center. Solar Energy Devices; Water Heating; Residential; Tax Credit
RELATING TO ENERGY RESOURCES.
Directs the public utilities commission to establish standards for solar water heater systems. Prohibits issuance of a building permit on or after 1/1/2010 for single-family residences that do not include a solar water heater system that meets the standards. Allows the energy resources coordinator to approve a variance for installation of solar water heater systems. Restricts the solar thermal energy systems tax credit available for single-family residential properties to those properties for which permits were issued prior to 1/1/2010. Provides that renewable energy technologies tax credits for systems installed and placed in service in 2009 for single-family residential properties may not be claimed by residential home developers. Tax Credit; New Markets
RELATING TO A NEW MARKETS TAX CREDIT.
Provides a new markets tax credit of percent of the amount paid to a qualified community development entity located in Hawaii to make a qualified equity investment. Requires taxpayer to have received an allowance of credit under section 45D of the Internal Revenue Code, the federal new markets tax credit. Effective July 1, 2020. Sunset December 31, 2010. High Technology Tax Incentives; Study
RELATING TO TAXATION.
Authorizes the Department of Taxation (DOTAX) to study and evaluate the economic impact of existing and proposed state tax incentives. Authorizes DOTAX to collect and evaluate information from January 1, 2002, as part of its annual survey of businesses that have benefited from various high technology tax incentives. Requires DOTAX to report annually to the Legislature, until 2012, on its findings of the economic impact of the tax incentives. Appropriates funds. (SB711 HD2)

RELATING TO TRANSIENT ACCOMMODATIONS TAX.
Requires the Department of Taxation (DOTAX) to coordinate with the Hawaii Tourism Authority and each respective county to identify property owners subject to the transient accommodations tax who operate vacation rentals and bed and breakfast establishments. Allows audits of these owners and other enforcement actions to ensure compliance with applicable laws relating to the transient accommodations tax. Requires the counties to share transient accommodations information with DOTAX. Requires DOTAX to provide annual reports, including providing information on the estimated amount of general excise tax and transient accommodations tax revenue that is uncollected, and therefore lost, due to the lack of county enforcement. Requires the counties to condition the approval of permits for the construction of new residential housing in tsunami inundation zones on the installation of tsunami warning sirens. Appropriates funds for the State Civil Defense Emergency Supply Program to equip emergency shelters. Requires the disability communications access board to identify internationally recognized symbols to be used in the event of a disaster or emergency to communicate notices to persons that do not understand verbal or written communications. Requires Department of Taxation to report to the Legislature on all available information and data collected from high technology businesses and thereafter submit an annual report of summary statistics on tax incentives and an evaluation of the effectiveness of high tech investment and research tax credits. Requires qualified high technology businesses benefiting from the high tech business investment and research activities tax credits to submit employment information to the Department of Taxation. Facilitates the enforcement of an order compelling a parent to pay child support, medical support, or other remedial care for his or her child, by providing that proof that the parent was present in court at the time the order was pronounced or that parent was served with the order, and proof that the parent did not comply with the order, constitutes prima facie evidence of a civil contempt of court.
