                   A  BILL  FOR  AN  ACT

RELATING TO VITAL RECORD FEES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 338-14.5, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�338-14.5  Copies of certificate; fees.  (a)  The fees for
 
 4 certified copies of birth, marriage, divorce, or death
 
 5 certificates issued by the department of health shall consist of
 
 6 $10 for the first copy issued and [$4] $6 for each copy issued
 
 7 thereafter[.], except as provided in subsection (b).  These fees
 
 8 shall be collected for each single request for certified copies.
 
 9 All fees received for the issuance of certified copies of birth,
 
10 marriage, divorce, or death certificates shall be remitted to the
 
11 director of health.  Upon the receipt of remittances under this
 
12 section, the director of health shall deposit:
 
13      (1)  $1 for each certified copy to the credit of the spouse
 
14           and child abuse special account established under
 
15           section 346-7.5;
 
16      (2)  $1 for each certified copy to the credit of the spouse
 
17           and child abuse special account established under
 
18           section 601-3.6;
 
19      (3)  $1 for each certified copy to the credit of the

 1           domestic violence prevention special fund established
 
 2           under section 321-1.3;
 
 3      (4)  [$1] $3 for each certified copy to the credit of the
 
 4           vital statistics improvement special fund established
 
 5           under section 338-14.6; and
 
 6      (5)  The remainder of the fee for each certified copy to the
 
 7           credit of the state general fund.
 
 8      (b)  Certified copies of certificates under subsection (a)
 
 9 shall be provided free of charge by the department of health to a
 
10 Native Hawaiian, as defined in section 10-2, if the copy is
 
11 requested in writing by and provided directly to the department
 
12 of Hawaiian home lands or office of Hawaiian affairs in
 
13 connection with a claim or an entitlement."
 
14      SECTION 2.  Act 216, Session Laws of Hawaii 1997, is amended
 
15 by amending section 13 to read as follows:
 
16      "SECTION 13.  This Act shall take effect on July 1, 1997[,
 
17 and shall be repealed on June 30, 2000; provided that any
 
18 statutory or session law material in this Act in existence on
 
19 June 30, 1997, shall be reenacted on July 1, 2000, in the same
 
20 form in which it existed on June 30, 1997]."
 
21      SECTION 3.  Statutory material to be repealed is bracketed.
 
22 New statutory material is underscored.
 
23      SECTION 4.  This Act shall take effect on July 1, 2011, and

 1 shall be repealed on June 30, 2003; provided that section
 
 2 338-14.5, Hawaii Revised Statutes, shall be reenacted in the form
 
 3 in which it read on the day before the approval of this Act.
