                   A  BILL  FOR  AN  ACT

PROPOSING AN AMENDMENT TO ARTICLE X, SECTIONS 2 AND 3, OF THE
   HAWAII CONSTITUTION RELATING TO THE BOARD OF EDUCATION.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to propose an
 
 2 amendment to Article X, sections 2 and 3, of the Constitution of
 
 3 the State of Hawaii to provide for the elimination of the current
 
 4 statewide board of education, replacing it with eight local
 
 5 boards elected by the people.
 
 6      SECTION 2.  Article X, section 2 of the Constitution of the
 
 7 State of Hawaii is amended to read as follows:

 9                   "[BOARD] BOARDS OF EDUCATION
 
10 
 
11      Section 2.  There shall be [a board] eight local boards of
 
12 education composed of members who shall be elected in a
 
13 nonpartisan manner by qualified voters, as provided by law, from
 
14 [two at-large] seven local school board districts.  The first
 
15 school board district shall be comprised of the area in and
 
16 around Hilo on the island of [Oahu and all other islands not
 
17 specifically enumerated.  The second school board district shall
 
18 be comprised of the islands of Hawaii, Maui, Lanai, Molokai,
 
19 Kahoolawe, Kauai and Niihau.  Each at-large school board district

 1 shall be divided into departmental school districts, as may be
 
 2 provided by law.  There shall be at least one member residing in each
 
 3 departmental school district.] Hawaii. The second school 
 
 4 board district shall be comprised of the area in and around Kona
 
 5 on the island of Hawaii.  The third school board district shall
 
 6 be comprised of the islands of Maui, Lanai, Molokai, and
 
 7 Kahoolawe.  The fourth school board district shall be comprised
 
 8 of the islands of of Kauai and Niihau.  The island of Oahu shall
 
 9 have four districts, districts five through eight, as follows:
 
10 that portion of the island comprised of Honolulu; that portion of
 
11 the island comprised of Central Oahu; the portion of the island
 
12 comprised of Leeward Oahu; and that portion of the island
 
13 comprised of Windward Oahu.  The Hawaii State Student Council
 
14 shall select a public high school student to serve as a nonvoting
 
15 member on the board of education." 
 
16      SECTION 3.  Article X, section 3 of the Constitution of the
 
17 State of Hawaii is amended to read as follows:

19             "POWER OF THE [BOARD] BOARDS OF EDUCATION
 
20 
 
21      Section 3.  The eight [board] boards of education shall each
 
22 have the power, as provided by law, to formulate [statewide]
 
23 district wide educational policy, exercise control over budgetary

 1 and personnel matters, and appoint [the superintendent] a
 
 2 director of education as the chief executive officer of [the
 
 3 public school system.] each respective school board district." 
 
 4      SECTION 4.  The question to be printed on the ballot shall
 
 5 be as follows:
 
 6      "Shall the current constitutional provisions on the creation
 
 7 and power of the Board of Education be amended to provide for the
 
 8 elimination of the statewide Board of Education, replacing it
 
 9 with a total of eight local school boards elected by the people?"
 
10      SECTION 5.  Constitutional material to be repealed is
 
11 bracketed.  New constitutional material is underscored.
 
12      SECTION 6.  This amendment shall take effect upon compliance
 
13 with article XVII, section 3, of the Constitution of the State of
 
14 Hawaii.
