                   A  BILL  FOR  AN  ACT

RELATING TO THE REDEVELOPMENT OF BARBERS POINT NAVAL AIR STATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to provide economic
 
 2 opportunities in the west Oahu area.  The creation of jobs in
 
 3 west Oahu would not only help to alleviate current traffic
 
 4 problems but will provide job opportunities for the many students
 
 5 who will be attending the future University of Hawaii West Oahu
 
 6 campus.  Further, the university will provide the necessary human
 
 7 resources for the high technology park once established.
 
 8      SECTION 2.  Chapter 206G, Hawaii Revised Statutes, is
 
 9 amended by adding three new sections to be appropriately
 
10 designated and to read as follows:
 
11      "�206G-       Kalaeloa high technology park.   The
 
12 commission shall identify real property that is suitable for use
 
13 as a high technology park and shall assist in the development of
 
14 an industrial park to facilitate the growth of the commercial
 
15 high technology industry in Hawaii.
 
16      �206G-     Business in high technology park; exemption from
 
17 taxation.  (a)  All goods or services purchased for the design or
 
18 construction of businesses residing in the high technology park
 
19 shall be exempt from state general excise taxes until the
 
20 business is operational.

 1      (b)  All revenues derived by businesses residing in the high
 
 2 technology park shall be exempt from state corporate income taxes
 
 3 for a period of ten years.
 
 4      �206G-    Reduction in lease rents.   Upon any business
 
 5 residing in the high technology park becoming operational, the
 
 6 lessor shall reduce lease rents in the amounts as follows:
 
 7      (1)  For the first three years that a business is in
 
 8           continuous operation, lease rents shall be waived;
 
 9      (2)  For the fourth and fifth year that a business is in
 
10           continuous operation, the business' lease rents shall
 
11           be twenty-five per cent of negotiated lease rents;
 
12      (3)  For the sixth and seventh year that a business is in
 
13           continuous operation, the business' lease rents shall
 
14           be fifty per cent of negotiated lease rents;
 
15      (4)  For the eighth and ninth year that a business is in
 
16           continuous operation, the business' lease rents shall
 
17           be seventy-five per cent of negotiated lease rents;
 
18      (5)  For the tenth year that a business is in continuous
 
19           operation, the business' lease rents shall be ninety-
 
20           five per cent of negotiated lease rents; and
 
21      (6)  For all subsequent years, the business shall be
 
22           responsible for its full lease rents under its contract
 
23           with the lessor.

 1      SECTION 3.  Section 206G-2, Hawaii Revised Statutes, is
 
 2 amended by adding two new definitions to be appropriately
 
 3 inserted and to read as follows:
 
 4      ""High technology" means emerging industries which are
 
 5 technology-intensive, including electronics, biotechnology, and
 
 6 alternative fuel source producers.
 
 7      "High technology park" means a tract of real property
 
 8 determined by the commission as being suitable for use as
 
 9 building sites for projects by a group of enterprises engaged in
 
10 industrial, processing, or manufacturing enterprises for high
 
11 technology, including research, training, technical analyses,
 
12 software development, and pilot plant or prototype product
 
13 development, and may include the installation of improvements to
 
14 the tract incidental to the use of the real property as a high
 
15 technology park, such as water, sewer, sewage and waste disposal,
 
16 and drainage facilities, sufficient to adequately service
 
17 projects in the high technology park, and provision of incidental
 
18 transportation facilities, power distribution facilities, and
 
19 communication facilities."
 
20      SECTION 4.  New statutory material is underscored.
 
21      SECTION 5.  This Act shall take effect upon its approval.
