                   A  BILL  FOR  AN  ACT

RELATING TO PESTICIDES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 149A-13, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  [The licensee shall pay $75 for each year, or fraction
 
 4 thereof, that the pesticide is licensed.]  A licensee of a
 
 5 consumer protection health benefit product shall pay a license
 
 6 fee of $45 for each year that a pesticide is licensed.  All other
 
 7 licensees shall pay a license fee of $65 for each year a
 
 8 pesticide is licensed.  Licensing fees may be increased or
 
 9 decreased from time to time by rules and may vary according to
 
10 the amount or quantity of pesticide to be sold, offered for sale,
 
11 or distributed.  The term of the license shall be for a period of
 
12 up to three years.  A license shall expire on December 31 of the
 
13 third year.  In case of renewal of license, a statement shall be
 
14 required only with respect to information which is different from
 
15 that furnished when the pesticide was licensed or last
 
16 relicensed.
 
17      For purposes of this subsection, "consumer protection health
 
18 benefit products" means any disinfectant, sanitizer, germicide,
 
19 biocide, and any other pesticide labeled for use directly on
 
20 humans or pets (including dogs, cats, horses, and other companion

 1 animals), and includes any pesticide labeled for use directly in
 
 2 areas in or around household premises."
 
 3      SECTION 2.  Statutory material to be repealed is bracketed.
 
 4 New statutory material is underscored.
 
 5      SECTION 3.  This Act shall take effect on July 1, 1999.
