Pesticide Revolving Fund

DESCRIPTION:
Removes the limit on the Pesticides Revolving Fund so that it
does not have to be amended each time the Department of
Agriculture wants an increase or decrease in the fund ceiling,

                   A  BILL  FOR  AN  ACT

RELATING TO PESTICIDES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 149A, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]�149A-13.5[]]  Pesticide use revolving fund; pesticide
 
 4 training workshops; training fee.(a)  There is established
 
 5 within the treasury of the State, a pesticide use revolving fund.
 
 6 The fund shall be administered by the department for the purposes
 
 7 of this section.  The fund shall consist of:
 
 8      (1)  Licensing and registration fees and charges collected
 
 9           by the department under section 149A-13(b); and
 
10      (2)  All fees collected by the department through the
 
11           collection of training fees in accordance with
 
12           subsection (c).
 
13      (b)  Moneys in the pesticide use revolving fund shall be
 
14 expended by the department to support the pesticide program's
 
15 registration and licensing, certification and education, and
 
16 compliance monitoring activities.  The department shall also
 
17 expend revolving fund moneys for developing integrated pest
 
18 management strategies on the establishment of pesticide training
 
19 workshops, educational programs, and other services for pesticide
 
20 users such as the agricultural pest control industry, the

 1 structural pest control industry, and consumer users of
 
 2 pesticides, which provide pesticide instruction in areas,
 
 3 including but not limited to, the collection, disposal, and
 
 4 recycling of pesticide containers and all other pesticide
 
 5 services deemed necessary by the department.  Moneys from the
 
 6 revolving fund may be used for the [purchase of services,]
 
 7 personnel, services, materials, and equipment[.] for the purposes
 
 8 of this section.
 
 9      Moneys expended by the department from the pesticide use
 
10 revolving fund for training workshops, educational programs, and
 
11 other services for the agricultural pest control industry, the
 
12 structural pest control industry, and consumer groups shall be
 
13 done so in a manner that appropriately addresses the needs of
 
14 each category of pesticide user.
 
15      (c)  The department may set fees for the educational
 
16 services and training provided under this section. 
 
17      (d)  All interest earned on the deposit or investment of the
 
18 moneys in the fund shall become a part of the fund.
 
19      [(e)  The balance in the revolving fund shall not exceed
 
20 $250,000.  All amounts in excess of the $250,000 shall be
 
21 deposited to the credit of the state general fund.]"
 
22      SECTION 2.  Statutory material to be repealed is bracketed.
 
23 New statutory material is underscored.
 
24      SECTION 3.  This Act shall take effect upon its approval.
