                   A  BILL  FOR  AN  ACT

RELATING TO GOVERNMENT OPERATIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the implementation of
 
 2 Act 230, Session Laws of Hawaii 1998, cannot be reasonably
 
 3 foreseen to be completed before the enacted repeal date of
 
 4 June 30, 2001.  The legislature further finds that the provision
 
 5 of the Act seeking to preserve rights and duties existing before
 
 6 the passage of the Act has resulted in the continuation and
 
 7 threat of further litigation, which is neither in the public
 
 8 interest nor conducive toward reaching agreement on a managed
 
 9 competition process.
 
10      SECTION 2.  Act 230, Session Laws of Hawaii 1998, is amended
 
11 as follows:
 
12      1.  By amending subsection (a) of section 14 to read:
 
13      "(a)  [Part IV of this Act shall not affect rights and
 
14 duties that matured, penalties that were incurred, and
 
15 proceedings that were begun, prior to the effective date of this
 
16 Act.]  Upon the effective date of this Act, no action or
 
17 proceeding may be initiated by any party against the State or
 
18 county regarding any contract with any private entity for goods,
 
19 services, or construction that was entered into pursuant to Part

 1 IV of this Act."
 
 2      2.  By amending section 17 to read:
 
 3      "SECTION 17.  This Act shall take effect upon approval[;
 
 4 provided that Part III and IV shall be repealed on June 30,
 
 5 2001]."
 
 6      SECTION 3.  Statutory material to be repealed is bracketed.
 
 7      SECTION 4.  This Act shall take effect upon its approval.
