                   A  BILL  FOR  AN  ACT
RELATING TO CRUELTY TO ANIMALS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the law prohibiting
 
 2 cruelty to animals may inadvertently apply to state or county
 
 3 approved sporting events, including rodeos and the annual Kona
 
 4 Billfish Tournament.  The purpose of this Act is to exempt
 
 5 government-approved sporting events and tournaments from that
 
 6 law.
 
 7      SECTION 2.  Section 711-1109, Hawaii Revised Statutes, is
 
 8 amended by amending subsection (2) to read as follows:
 
 9      "(2)  [Subsection (1)(a), (b), (d), (e) and the following
 
10 subsection (3) are not applicable to accepted] This section shall
 
11 not apply to:
 
12      (a)  Accepted veterinary practices [and to activities];
 
13      (b)  Activities carried on for scientific research governed
 
14           by standards of accepted educational or medicinal
 
15           practices[.]; or
 
16      (c)  State or county approved sporting events and
 
17           tournaments, including, but not limited to, sport
 
18           fishing tournaments and rodeos."
 
19      SECTION 3.  This Act does not affect rights and duties that
 
20 matured, penalties that were incurred, and proceedings that were

 1 begun, before its effective date.
 
 2      SECTION 4.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 5.  This Act shall take effect upon its approval.
