licensed to practice medicine in Hawaii.  Makes the license to
practice occupations specified in section 321-13(a)(1) valid for

                   A  BILL  FOR  AN  ACT

RELATING TO HEALTH.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1                              PART I
 
 2      SECTION 1.  Chapter 432E, Hawaii Revised Statutes, is
 
 3 amended by adding a new section to be appropriately designated
 
 4 and to read as follows:
 
 5      "�432E-     Licensure of managed care plan medical
 
 6 directors.  The medical director of any managed care plan
 
 7 providing services in the State shall hold an unlimited license
 
 8 to practice medicine in the State pursuant to chapter 453 or
 
 9 460."
 
10      SECTION 2.  Section 432E-1, Hawaii Revised Statutes, is
 
11 amended by adding a new definition to be appropriately inserted
 
12 and to read as follows:
 
13      ""Medical director" means the person who is authorized under
 
14 a managed care plan and who makes decisions for the plan denying
 
15 or allowing payment for medical treatments, services, or supplies
 
16 based on medical necessity or other appropriate medical or health
 
17 plan benefit standards."

 1                              PART II
 
 2      SECTION 3.  Section 321-15, Hawaii Revised Statutes, is
 
 3 amended by amending its title and subsection (a) to read as
 
 4 follows:
 
 5      "�321-15  [Annual] Biennial registration; fees, failure to
 
 6 register.(a)  Every person holding a license to practice any
 
 7 occupation specified in section 321-13(a)(1) shall reregister
 
 8 with the department of health[,] every other year in accordance
 
 9 with the rules of the department, before February 1 [of each
 
10 year] except where superseded by federal law, and shall pay a
 
11 reregistration fee.  The failure, neglect, or refusal of any
 
12 person holding such a license to reregister or pay the
 
13 reregistration fee, after thirty days of delinquency, shall
 
14 constitute a forfeiture of the person's license; provided that
 
15 the license shall be restored upon written application therefor
 
16 together with a payment of all delinquent fees and an additional
 
17 late reregistration fee that may be established by the director
 
18 of health.  All fees collected pursuant to this section shall be
 
19 deposited into the environmental health education fund
 
20 established under section 321-27."

22      SECTION 4.  Statutory material to be repealed is bracketed.
