DESCRIPTION:
Amends the definition of land in section 520-2, Hawaii Revised
Statutes (HRS), to include unimproved government-owned trails
established under section 198D-6, HRS.  States that the
definition does not include any land used for any commercial

                     A BILL FOR AN ACT

RELATING TO LANDOWNER LIABILITY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 520-2, Hawaii Revised Statutes, is
 
 2 amended by amending the definition of "land" to read as follows:
 
 3      ""Land" means land, roads, water, water courses, unimproved
 
 4 lands owned or controlled by government that are used for trails
 
 5 as established under section 198D-6, private ways and buildings,
 
 6 structures, and machinery or equipment when attached to realty[,
 
 7 other than lands owned by the government].  "Land" does not
 
 8 include:
 
 9      (1)  Government owned or controlled land, other than those
 
10           unimproved lands owned or controlled by government that
 
11           are used for trails as established under section
 
12           198D-6; and
 
13      (2)  Land used by any person for any commercial purpose."
 
14      SECTION 2.  This Act does not affect rights and duties that
 
15 matured, penalties that were incurred, and proceedings that were
 
16 begun, before its effective date.
 
17      SECTION 3.  New statutory material is underscored.
 
18      SECTION 4.  This Act shall take effect upon its approval.
