                   A BILL FOR AN ACT

RELATING TO BUDGETING.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 37, Hawaii Revised Statutes, is amended

by adding a new section to be appropriately designated and to

read as follows:

"37- Conformance to legislative priorities. If revenue

shortfalls cause modification or reduction of allotments under

section 37-35 or 37-36, reductions in allotment shall so far as

is practical be made in equal percentages across affected

appropriations; provided that equality in reductions shall not be

required if it produces an illegal result. If revenues are

subsequently greater than projected at the time of the

modification or reduction, the director of finance shall promptly

restore allotments in proportion to any reductions made and

consistent with actual revenue, so that allotments so far as is

practical shall be proportionate to the legislature's

appropriations. The director of finance shall not reduce

allotments based on targeted or anticipated savings, changing

conditions, changes in law, or efficiency increases, unless

appropriated moneys freed thereby cannot be used for the

programmatic purposes of the appropriation."
