                     A BILL FOR AN ACT

RELATING TO UNEMPLOYMENT BENEFITS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 383-29, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b) (1)  Benefits based on service in an instructional,
 
 4 research, or principal administrative capacity in an institution
 
 5 of education shall not be paid to an individual for any week of
 
 6 unemployment which begins during the period between two
 
 7 successive academic years, or during a similar period between two
 
 8 regular terms, whether or not successive, or during a period of
 
 9 paid sabbatical leave provided for in the individual's contract,
 
10 if the individual performed such services in the first of such
 
11 academic years or terms and if there is a contract or a
 
12 reasonable assurance that such individual will perform services
 
13 in any such capacity for any institution of education in the
 
14 second of such academic years or terms.  This paragraph shall not
 
15 apply to substitute teachers who have a contract or agreement to
 
16 provide substitute teaching services during the ensuing academic
 
17 year or term.
 
18      (2)  Benefits based on service in any other capacity for any
 
19           educational institution shall not be paid to any
 
20           individual for any week which commences during a period

 1           between two successive academic years or terms if such
 
 2           individual performs such services in the first of such
 
 3           academic years or terms and there is a reasonable
 
 4           assurance that such individual will perform such
 
 5           services in the second of such academic years or terms,
 
 6           except that, if compensation is denied to any
 
 7           individual under this subsection and such individual
 
 8           was not offered an opportunity to perform such services
 
 9           for the educational institution for the second of such
 
10           academic years or terms, such individual shall be
 
11           entitled to a retroactive payment of compensation for
 
12           each week for which the individual filed a timely claim
 
13           for compensation and for which compensation was denied
 
14           solely by reason of this [clause.] paragraph.
 
15      (3)  Benefits based on service in any instructional,
 
16           research, or principal administrative capacity in any
 
17           educational institution or based on other services in
 
18           any educational institution shall not be paid to any
 
19           person for any week of unemployment which begins during
 
20           an established and customary vacation or recess for a
 
21           holiday if the person performs service in the period
 
22           immediately preceding the vacation or recess and there
 
23           is reasonable assurance that the person will be

 1           provided employment immediately succeeding the vacation
 
 2           or recess.
 
 3      (4)  The provisions of paragraphs (1), (2), and (3) apply
 
 4           also to services performed while employed by a
 
 5           governmental agency which is established and operated
 
 6           exclusively for the purpose of providing such services
 
 7           to one or more educational institutions."
 
 8      SECTION 2.  New statutory material is underscored.
 
 9      SECTION 3.  This Act shall take effect upon its approval.
