                   A  BILL  FOR  AN  ACT

RELATING TO THE HAWAIIAN LANGUAGE COLLEGE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the Hawaiian language
 
 2 college was established at the University of Hawaii at Hilo in
 
 3 1997, to serve as a focal point for the revitalization of the
 
 4 Hawaiian language.  As can be expected, questions were raised
 
 5 about this new college during its beginnings.  However, since
 
 6 then the commitment of the faculty and the progress made by the
 
 7 college have demonstrated its viability and relevance to the
 
 8 community.
 
 9      One of the problems faced by the Hawaiian language college
 
10 is the statutory requirement to contract with the Research
 
11 Corporation of the University of Hawaii for research and training
 
12 activities that cannot be provided by state agencies.  Since the
 
13 Hawaiian language college has decided to conduct its business in
 
14 the Hawaiian language, it is difficult to do business with the
 
15 research corporation, which is set up to operate in the English
 
16 language.  It should be noted that the Hawaiian language is one
 
17 of the two official languages of the State (the other being
 
18 English).  An exception should be made to allow the college to
 
19 contract directly with providers.  This will enable it to expand
 
20 and operate more efficiently.

 1      SECTION 2.  Section 304-10.5, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  Notwithstanding any law to the contrary, when the
 
 4 university determines that neither the university nor another
 
 5 state agency can more effectively or efficiently accomplish the
 
 6 purposes of the sponsored research and training activities, the
 
 7 university shall contract with the Research Corporation of the
 
 8 University of Hawaii established under chapter 307 to provide
 
 9 management and other services as described in subsection (b) to
 
10 support the university's research and training activities[.];
 
11 provided that, when conducting business in the Hawaiian language,
 
12 the college of Hawaiian language may contract directly with
 
13 providers.  Contracts by the university with the research
 
14 corporation pursuant to this section shall be limited to
 
15 sponsored research and training projects, except that university
 
16 projects supported by state-appropriated funds may also be
 
17 contracted to the research corporation pursuant to rules adopted
 
18 by the university."
 
19      SECTION 3.  Statutory material to be repealed is bracketed.
 
20 New statutory material is underscored.
 
21      SECTION 4.  This Act shall take effect upon its approval.
