                   A  BILL  FOR  AN  ACT

MAKING AN EMERGENCY APPROPRIATION FOR STATE GOVERNMENT TO
   IMPLEMENT YEAR 2000 COMPLIANCE EFFORTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  This Act is recommended by the governor for
 
 2 immediate passage in accordance with section 9 of article VII of
 
 3 the Constitution of the State of Hawaii.
 
 4      SECTION 2.  Although Act 116, Session Laws of Hawaii 1998,
 
 5 appropriated a designated sum to the information processing
 
 6 services program for remediation of computer systems for Year
 
 7 2000 compliance, a critical funding emergency exists.  Additional
 
 8 requirements have made it necessary to create a parallel
 
 9 production environment to permit a phased migration of operating
 
10 systems through the year 1999.  The cost of establishing the
 
11 second production system has depleted the department's available
 
12 resources, making it impossible to provide for unanticipated
 
13 application modifications, equipment, software, or services that
 
14 may be required.
 
15      The purpose of this Act is to appropriate additional moneys
 
16 to allow for the testing, modification, and support of the
 
17 State's computer systems for Year 2000 compliance.
 
18      SECTION 3.  There is appropriated out of the general
 
19 revenues of the State of Hawaii the sum of $1,040,000 or so much

 1 thereof as may be necessary for fiscal year 1998-1999 to be used
 
 2 in support of the State's Year 2000 remediation efforts.
 
 3      SECTION 4.  The sum appropriated shall be expended by the
 
 4 department of accounting and general services for the purposes of
 
 5 this Act.  With the approval of the governor, the department may
 
 6 delegate responsibility and transfer funds to other state
 
 7 agencies for purposes of this Act.
 
 8      SECTION 5.  All unexpended and unencumbered balances of the
 
 9 appropriation made by section 3 of this Act as of the close of
 
10 business on June 30, 1999, shall not lapse and shall be carried
 
11 over and may be expended during fiscal year 1999-2000; provided
 
12 that on June 30, 2000, all unexpended and unencumbered balances
 
13 shall lapse into the general fund of the State.
 
14      SECTION 6.  The department of accounting and general
 
15 services shall submit a report on all expenditures and
 
16 encumbrances made pursuant to the State's Year 2000 remediation
 
17 efforts to the legislature no later than twenty days prior to the
 
18 convening of the regular session of 2000.
 
19      SECTION 7.  This Act shall take effect upon its approval.
