REPORT TITLE:
Civil Service


DESCRIPTION:
Authorizes the director of DHRD to work collaboratively with the
various stakeholders governed by chapters 76, 77, 78, 79, 80, 81,
and 82, HRS, to draft replacement civil service legislation, if
necessary; report civil service bill to the 2000 legislature;

                   A  BILL  FOR  AN  ACT

RELATING TO THE CIVIL SERVICE SYSTEM FOR PUBLIC OFFICERS AND
   EMPLOYEES.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  For several decades the civil service system has
 
 2 admirably met its mandate to support Hawaii state government's
 
 3 mission to serve the people of Hawaii.  Within the past few years
 
 4 however, with the advancement of digital technology, public needs
 
 5 have changed at a constant and ever-increasing rate.  Our current
 
 6 civil service system, which was created at a time when digital
 
 7 technology was at best, mostly theory, has outlived its
 
 8 usefulness.  Therefore, for state government to continue to meet
 
 9 the public's needs, the civil service system will have to be
 
10 modernized to provide flexible, timely, responsive, and people
 
11 centered personnel support.
 
12      To create an opportunity that encourages all stakeholders to
 
13 work collaboratively to co-create this modernized civil service,
 
14 it is proposed that a "fresh-start" provision be established for
 
15 civil service laws.  Such a "fresh-start" concept would not only
 
16 serve to "clear-the-deck" but would also capture the public's
 
17 attention and thus provide the drive to seriously engage in the
 
18 process of co-creating a new statutory framework by all
 
19 stakeholders.

 1      It is further proposed that the director of human resources
 
 2 development be charged with the responsibility to establish
 
 3 partnerships with all stakeholders, labor and management
 
 4 included, and begin to design and effectuate a process to
 
 5 modernize the civil service system.
 
 6      SECTION 2.  The director of human resources development
 
 7 shall identify and work collaboratively with the various
 
 8 stakeholders governed by chapters 76, 77, 78, 79, 80, 81, and 82,
 
 9 Hawaii Revised Statutes, in order to draft replacement
 
10 legislation if deemed necessary.  The director, with all
 
11 stakeholders agreeing, shall engage a team of
 
12 mediators/facilitators to keep all parties on task and on track.
 
13 The mediators/facilitators will submit monthly progress reports
 
14 to the legislature.  The director of human resources and the
 
15 stakeholders shall submit model legislation to a joint house and
 
16 senate labor committee meeting on November 15, 1999.  The
 
17 stakeholders shall continue to meet after the joint meeting and
 
18 make any revisions to the proposed legislation based on feedback
 
19 from the joint committee.  The director shall present a revised
 
20 and final civil service bill for consideration by the legislature
 
21 by January 15, 2000.
 
22      SECTION 3.  Notwithstanding any other law to the contrary,
 
23 the legislature shall adopt legislation to be effective June 30,

 1 2000, to define the employment of persons in the civil service
 
 2 system.  This legislation shall be governed by the merit
 
 3 principle.
 
 4      SECTION 4.  Effective June 30, 2000, chapters 76, 77, 78,
 
 5 79, 80, 81, and 82, Hawaii Revised Statutes, are repealed.
 
 6      SECTION 5.  This Act shall take effect upon approval.
