                   A  BILL  FOR  AN  ACT

RELATING TO GAMBLING.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to require an
 
 2 advisory referendum on the issue of whether the State should
 
 3 legalize gaming and if so, what form of legalized gambling shall
 
 4 be allowed.  This issue has engendered several studies and heated
 
 5 debate among the business community, the government, and the
 
 6 community at large.  The legislature finds that it is appropriate
 
 7 that the public make an advisory  decision on whether to allow
 
 8 legalized gambling in some form.
 
 9      It is the intent of the legislature that the results of the
 
10 advisory referendum will represent a non-binding indication of
 
11 the electorate's opinion on the issue of legalized gambling.
 
12 While merely advisory, the advisory referendum will assist the
 
13 legislature in its consideration of the issue of legalized
 
14 gambling.
 
15      SECTION 2.  At the 2000 general election there shall be an
 
16 advisory referendum on the question of Hawaii's need for
 
17 legalized gambling and if so, what form of legalized gambling is
 
18 preferred.  The chief election officer of the State shall submit
 
19 two separate questions to the electorate with instructions as

 1 follows:
 
 2      1.  The first proposal shall read:  "Shall the State of
 
 3 Hawaii allow some form of legalized gambling?"
 
 4      2.  The second proposal shall be submitted in the form of
 
 5 three questions and shall read:  "Indicate which forms, if any,
 
 6 of legalized gambling of which you approve:
 
 7      (a)  Do you support the form of legalized gambling known as
 
 8           pari-mutuel racing?
 
 9      (b)  Do you support the form of legalized gambling known as
 
10           the state lottery?
 
11      (c)  Do you support the form of legalized gambling known as
 
12           shipboard gaming?"
 
13      The chief election officer shall publish a notice of the
 
14 referendum proposals and descriptive information of each type of
 
15 gambling, in a newspaper of general circulation in the State at
 
16 least thirty days before the date of the referendum.  The notice
 
17 of the referendum shall also be available at all public libraries
 
18 in the State and the office of the county clerk of each county.
 
19      The ballot shall print the questions and each question shall
 
20 have designated spaces to mark YES or NO.  The first proposal
 
21 shall be considered approved only if approved by a majority of
 
22 all the votes tallied upon the question.

 1      SECTION 3.  There is appropriated out of the general
 
 2 revenues of the State of Hawaii the sum of $        , or so much
 
 3 thereof as may be necessary for fiscal year 1999-2000, and the
 
 4 same sum, or so much thereof as may be necessary for fiscal year
 
 5 2000-2001, to carry out the purposes of this Act.
 
 6      The sums appropriated shall be expended by the office of
 
 7 elections.
 
 8      SECTION 4.  This Act shall take effect upon its approval.
