                   A  BILL  FOR  AN  ACT

MAKING AN EMERGENCY APPROPRIATION TO PAY THE SHARE OF HEALTH
   INSURANCE CARRIER REFUND AND RATE CREDIT AMOUNTS DUE TO THE
   FEDERAL GOVERNMENT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  This Act is recommended by the Governor for
 
 2 immediate passage in accordance with section 9 of article VII of
 
 3 the Constitution of the State of Hawaii.
 
 4      SECTION 2.  Act 141, Session Laws of Hawaii 1998, authorized
 
 5 the return to the state general fund of $31,315,640, representing
 
 6 the State's share of health insurance carrier refunds, rate
 
 7 credits, and any interest accrued thereon.  The federal
 
 8 government provides the State with funding for fringe benefit
 
 9 costs which include health insurance premium costs.  As a result,
 
10 the federal government is entitled to a portion of that refund
 
11 and the U.S. Department of Health and Human Services is
 
12 requesting that the State make immediate payment of that portion.
 
13 No funds have been previously appropriated to make this payment.
 
14      SECTION 3.  There is appropriated out of the general
 
15 revenues of the State of Hawaii the sum of $        , or so much
 
16 thereof as may be necessary for the fiscal year 1998-1999, to be
 
17 used for the return to the federal government of the federal
 
18 share of health insurance rate credits and rebates received by

 1 the State.
 
 2      SECTION 4.  This Act shall take effect on its approval.
