DESCRIPTION:
Creates an information technology special fund, into which shall
be transferred 1% of all state fund appropriations for capital
improvements, and will be expended solely for the purposes of

                     A BILL FOR AN ACT

RELATING TO INFORMATION TECHNOLOGY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  As the twenty-first century approaches,
 
 2 technological innovations and advancements have made drastic
 
 3 changes in our everyday lifestyles.  The easy access to
 
 4 information and the speed in which we are able to connect with
 
 5 the world around us are valuable assets to our workplaces,
 
 6 schools, and communities.  The legislature finds that because of
 
 7 the prominent role information technologies, such as computer
 
 8 products and facilities needed to use modern data, voice, and
 
 9 video technology, play in our society, there is a need to ensure
 
10 funding for the acquisition, installation, and maintenance of
 
11 information technology for the State.
 
12      The purpose of this Act is to create an information
 
13 technology special fund, into which will be transferred one per
 
14 cent of all state fund appropriations for capital improvements,
 
15 which will be used for the purposes of acquiring, installing, and
 
16 maintaining all of the State's information technologies.
 
17      SECTION 2.  Chapter 103, Hawaii Revised Statutes, is amended
 
18 by adding a new section to be appropriately designated and to
 
19 read as follows:

 1      "�103-    Information technology special fund.  (a)  There
 
 2 is created an information technology special fund, into which
 
 3 shall be transferred one per cent of all state fund
 
 4 appropriations for capital improvements designated for the
 
 5 construction cost element; provided that this transfer shall
 
 6 apply only to capital improvement appropriations that are
 
 7 designated for the construction or renovation of state buildings.
 
 8      (b)  The information technology special fund shall be used
 
 9 solely for the following purposes:
 
10      (1)  Costs related to the procurement of information
 
11           technologies, including computer products and
 
12           facilities needed to use modern data, voice, and video
 
13           technology;
 
14      (2)  Costs related to the installation of information
 
15           technologies, including any necessary site
 
16           modifications;
 
17      (3)  Upkeep services, including the maintenance and repair
 
18           of information technologies.
 
19      (c)  The one per cent amount, which is included in all
 
20 capital improvement appropriations, shall be calculated at the
 
21 time the appropriation bills are signed into law.  The moneys
 
22 shall be transferred into the information technology special fund
 
23 upon availability of moneys from the appropriations.

 1      (d)  The comptroller shall decide on the specific
 
 2 technological objects to acquire, giving first consideration to
 
 3 placing appropriate information technologies at the locations of
 
 4 the original appropriation.
 
 5      The selection of, reviewing of design, execution, and
 
 6 placement of information technologies shall be the responsibility
 
 7 of the comptroller in consultation with the affected agency or
 
 8 department.
 
 9      Expenditures from the information technology special fund
 
10 shall be made by the comptroller."
 
11      SECTION 3.  New statutory material is underscored.
 
12      SECTION 4.  This Act shall take effect upon its approval.
