                   A  BILL  FOR  AN  ACT

RELATING TO MOTOR CARRIERS. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that current state law
 
 2 that requires the monitoring of storm water runoff by motor
 
 3 carriers is excessively burdensome.
 
 4      The purpose of this Act is to conform Hawaii's practice of
 
 5 monitoring storm water runoff from motor carriers to that of the
 
 6 majority of the states by permitting visual monitoring and
 
 7 analysis of storm water runoff.
 
 8      SECTION 2.  Chapter 271, Hawaii Revised Statutes, is amended
 
 9 by adding a new section to be appropriately designated and to
 
10 read as follows:
 
11      "�271-     Motor carriers and private carriers of property
 
12 by motor vehicles; monitoring.  Any monitoring of storm water
 
13 runoff by a motor carrier or private carrier of property by motor
 
14 vehicle that is required by law shall be done by visual
 
15 observation of color, odor, turbidity, floating solids, foam,
 
16 oil, sheen, or other obvious indicators of storm water pollution.
 
17 The examination shall be conducted in a well lighted area.  No
 
18 laboratory tests are required to be performed on any samples
 
19 gathered."

 1      SECTION 3.  New statutory material is underscored.
 
 2      SECTION 4.  This Act shall take effect upon its approval.
