                     A BILL FOR AN ACT

RELATING TO PICKUP TRUCKS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  Section 291-14, Hawaii Revised Statutes, is
 
 2 amended to read:
 
 3      "�291-14  Pickup trucks; passenger restrictions.(a)  No
 
 4 person shall stand in the bed or load-carrying area of any motor
 
 5 vehicle commonly known as a pickup truck while the vehicle is in
 
 6 operation.  No operator of any pickup truck shall operate the
 
 7 vehicle with a passenger seated in the bed or load-carrying area
 
 8 of the vehicle unless:
 
 9      (1)  There is no seating available in the cab of the
 
10           vehicle;
 
11      (2)  The side racks of the vehicle are securely attached and
 
12           the tailboard or tailgate is securely closed;
 
13      (3)  Every passenger in the bed or load-carrying area of the
 
14           vehicle is seated on the floor and does not attempt to
 
15           control unlashed cargo.
 
16      (b)  This section shall not apply to persons or corporations
 
17 operating a business or businesses that serve the public, who or
 
18 which are subject to the jurisdiction, supervision, and
 
19 regulations prescribed by state agencies or departments nor to

 1 their agents or employees when engaged in the business of such
 
 2 persons or corporations.
 
 3      (c)  No operator of any pickup truck may operate the vehicle
 
 4 with any passenger twelve years of age or under; thirteen years
 
 5 of age or under on or after July 1, 1999; fourteen years of age
 
 6 or under on or after January 1, 2000; fifteen years of age or
 
 7 under on or after January 1, 2001; sixteen years of age or under
 
 8 on or after January 1, 2002; seventeen years of age or under on
 
 9 or after January 1, 2003; and eighteen years of age or under on
 
10 or after January 1, 2004 in the bed or load-carrying area of the
 
11 vehicle, unless one of the following applies:
 
12      (1)  An emergency exists that threatens the life of the
 
13           passenger being transported in the bed or load-carrying
 
14           area of the vehicle; or
 
15      (2)  The vehicle is being operated in parades, caravans, or
 
16           exhibitions which are officially authorized or
 
17           otherwise permitted by law.
 
18      (d)  Any person who violates this section shall be subject
 
19 to a fine of $25 for each violation; provided that any person who
 
20 violates subsection (c) shall be subject to a fine of $50 for
 
21 each separate violation.
 
22      (e)  As used in this section, "pickup truck" means a light
 
23 truck that has a cab on the front part of the vehicle covering

 1 the driver's seat and an open bed behind the cab designed
 
 2 primarily to transport property or cargo, with sides and a
 
 3 tailgate to retain the contents within the confines of the bed,
 
 4 and has a maximum gross vehicle weight rating (GVWR) of 11,000
 
 5 pounds or less." 
 
 6      SECTION 2.  New statutory material is underscored.
 
 7      SECTION 3.  This Act shall take effect on July 1, 1999
