DESCRIPTION:
Appropriates funds to the office of Hawaiian affairs to offset
the cost of waiving tuition for Hawaiian students in the
University of Hawaii system.  States that funds used for this
purpose count as credit against the State's liability for ceded

                   A  BILL  FOR  AN  ACT

RELATING TO TUITION WAIVERS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that young Hawaiians would
 
 2 benefit from having positive role models and further, as a
 
 3 demographic group, Hawaiians require more financial assistance to
 
 4 achieve higher education goals.
 
 5      The purpose of this Act is to appropriate funds to offset
 
 6 costs associated with the provision of tuition waivers by the
 
 7 University of Hawaii for Hawaiians.
 
 8      SECTION 2.  The office of Hawaiian affairs shall act as a
 
 9 depository for funds appropriated by the legislature for the
 
10 purpose of offsetting costs incurred by the University of Hawaii
 
11 for providing native Hawaiian students, part Hawaiian students,
 
12 or a combination of both, with tuition waivers to attend the
 
13 University of Hawaii at Manoa or any campus of the University of
 
14 Hawaii system.
 
15      SECTION 3.  The tuition waivers awarded by the University of
 
16 Hawaii pursuant to this Act shall be awarded to Hawaiian students
 
17 who are:
 
18      (1)  Enrolled in graduate or undergraduate courses within
 
19           the university system for the purpose of obtaining a

 1           degree; or
 
 2      (2)  Participating in student recruitment programs within
 
 3           the university system.
 
 4      As used in this Act, "Hawaiian" means any descendant of the
 
 5 aboriginal peoples inhabiting the Hawaiian islands that:
 
 6      (1)  Exercised sovereignty and subsisted in the Hawaiian
 
 7           Islands in 1778; and
 
 8      (2)  Have continued to reside in Hawaii since 1778.
 
 9      SECTION 4.  There is appropriated out of the general
 
10 revenues of the State of Hawaii the sum of $0, or so much thereof
 
11 as may be necessary for fiscal year 1999-2000, for the purpose of
 
12 offsetting the University of Hawaii's cost of providing native
 
13 Hawaiian students, part Hawaiian students, or a combination of
 
14 both, with tuition waivers to attend the University of Hawaii at
 
15 Manoa or any campus of the University of Hawaii system.
 
16      SECTION 5.  The sum appropriated shall be expended by the
 
17 office of Hawaiian affairs for the purposes of this Act; provided
 
18 that any funds not expended by the office of Hawaiian affairs for
 
19 the sole purpose of reimbursing the University of Hawaii for
 
20 providing tuition waivers to native Hawaiian and part Hawaiian
 
21 students shall lapse to the state general fund on June 30, 2000.
 
22      SECTION 6.  All moneys appropriated under section 4 of this
 
23 Act to the office of Hawaiian affairs shall be credited against

 1 the State's obligation to pay the office of Hawaiian affairs a
 
 2 pro rata share of ceded land revenues.  Any claim of ceded land
 
 3 revenues owed and paid by the State to the office of Hawaiian
 
 4 affairs occurring in the 1999-2000 fiscal year shall be reduced
 
 5 by the amount appropriated by this Act.
 
 6      The office of Hawaiian affairs shall keep accurate records
 
 7 and accounts of funds appropriated and disbursed under this Act.
 
 8 At the end of fiscal year 1999-2000, the office of Hawaiian
 
 9 affairs shall transmit a financial report on the disbursement of
 
10 funds pursuant to this Act and a refund, if any, of any
 
11 unexpended funds appropriated for this Act's purpose to the
 
12 department of budget and finance to be paid into the state
 
13 general fund.  If any moneys appropriated pursuant to this Act
 
14 are refunded to the department of budget and finance by the
 
15 office of Hawaiian affairs, the amount shall be debited against
 
16 the State's obligation to pay the office of Hawaiian affairs a
 
17 pro rata share of ceded land revenues in the succeeding fiscal
 
18 year.
 
19      SECTION 7.  This Act shall take effect on July 1, 1999.
