HCB Medicaid Waiver Services


DESCRIPTION:
Mandates transfer of DOH's HTH 501 funds to the DHS to fund home-
and community-based services under the DHS's Medicaid waiver
program.  Requires DOH to reorganize the functions of the
developmental disabilities division to ensure the closure of
Waimano, and to provide for the clients from Waimano to be

                   A  BILL  FOR  AN  ACT

RELATING TO SERVICES FOR PERSONS WITH DEVELOPMENTAL DISABILITIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that with the closing of
 
 2 the Waimano training school and hospital this summer, about six
 
 3 hundred clients are now on the waiting list for home- and
 
 4 community-based services under the Medicaid waiver administered
 
 5 by the department of human services.  However, funds within the
 
 6 department of health under HTH 501 (POS funds) amounting to
 
 7 $2,000,000 remain unmatched by the federal government.  If these
 
 8 funds were matched, about one hundred seventy of those on the
 
 9 waiting list could be served.  The purpose of this Act is to
 
10 mandate the transfer of department of health HTH 501 (POS funds)
 
11 to the department of human services to fund home- and community-
 
12 based services under the Medicaid waiver program administered by
 
13 the department of human services.
 
14      SECTION 2.  The department of budget and finance shall take
 
15 the appropriate steps to transfer the funds under HTH 501 (POS
 
16 funds) from the department of health to the appropriate budget
 
17 item designation under the department of human services so that
 
18 the department of human services becomes the receiver of state
 
19 funds eligible for federal matching funds to fund the provision

 1 of home- and community-based services under the Medicaid waiver
 
 2 program administered by the department of human services, for the
 
 3 fiscal year beginning July 1, 1999.
 
 4      SECTION 3.  The director of health shall take the
 
 5 appropriate steps to reorganize the functions of the
 
 6 developmental disabilities division to ensure the closure of the
 
 7 Waimano training school and hospital and to ensure that the
 
 8 clients at Waimano be transferred to the community.
 
 9      SECTION 4.  This Act shall take effect upon its approval.
