                   A  BILL  FOR  AN  ACT

RELATING TO CIVIL RIGHTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  (a)  There is created a temporary pilot program,
 
 2 to be administered by the department of the attorney general, for
 
 3 the collection, storage, dissemination, and analysis of all hate
 
 4 crime data from all state entities that have primary
 
 5 investigative action or program responsibility for adult or
 
 6 juvenile offenses, including the county police departments, the
 
 7 county prosecutors, the family courts, and the state departments
 
 8 or agencies responsible for administering any correctional
 
 9 facilities.  For purposes of this Act, "hate crime" means any
 
10 criminal act motivated in whole or in part by hostility toward,
 
11 or disdain for, a victim's real or apparent race, religion,
 
12 sexual orientation, ethnicity, or disability.
 
13      (b)  State entities that have investigative, detention,
 
14 custodial, adjudicative, or program responsibility for adult or
 
15 juvenile offenses shall cooperate with the attorney general in
 
16 the establishing of the temporary hate crime reporting pilot
 
17 program by:
 
18      (1)  Providing information that is in the entity's files
 
19           that can be included pursuant to the format approved by
 
20           the attorney general;

 1      (2)  Maintaining internal procedures consistent with uniform
 
 2           procedures and guidelines as provided by the attorney
 
 3           general;
 
 4      (3)  Reporting information to the attorney general that is
 
 5           timely, complete, and accurate after the occurrence of
 
 6           an event over which the entity had direct
 
 7           responsibility; and
 
 8      (4)  Maintaining procedures for the periodic checking of
 
 9           information to minimize the possibility of storing and
 
10           maintaining inaccurate information.
 
11      (c)  The attorney general shall summarize and analyze
 
12 reports of hate crimes that are received, and shall compile and
 
13 transmit a report of hate crime data to the legislature by
 
14 January 10, 2000.
 
15      (d)  One hundred twenty days after the submission to the
 
16 legislature of its final report, the pilot program shall cease to
 
17 exist.
 
18      SECTION 2.  This Act shall take effect upon its approval.
