                   A  BILL  FOR  AN  ACT

RELATING TO DANGEROUS WEAPONS.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 134-52, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�134-52  Switchblade and butterfly knives; prohibitions;
 
 4 penalty.(a)  Whoever knowingly manufactures, sells, transfers,
 
 5 possesses, or transports in the State any switchblade or
 
 6 butterfly knife [, being] shall be guilty of a misdemeanor.
 
 7      (b)  For the purpose of this section, switchblade or
 
 8 butterfly knife means any knife having a blade [which] that opens
 
 9 automatically:
 
10      (1)  [by] By hand pressure applied to a button or other
 
11           device in the handle of the knife[,]; or
 
12      (2)  [by] By operation of inertia, gravity, or both[, shall
 
13           be guilty of a misdemeanor]. 
 
14      [(b)](c)  Whoever knowingly or intentionally sells or
 
15 transfers a switchblade or butterfly knife to a minor shall be
 
16 guilty of a class C felony.

 1      (d)  Whoever knowingly possesses or intentionally uses or
 
 2 threatens to use a switchblade or butterfly knife while engaged
 
 3 in the commission of a crime shall be guilty of a class C
 
 4 felony."
 
 5      SECTION 2.  This Act does not affect rights and duties that 
 
 6 matured, penalties that were incurred, and proceedings that were
 
 7 begun, before its effective date.
 
 8      SECTION 3.  Statutory material to be repealed is bracketed.
 
 9 New statutory material is underscored.
 
10      SECTION 4.  This Act shall take effect upon its approval.
