                    SENATE  CONCURRENT
                        RESOLUTION

  CALLING FOR A TASK FORCE AND REQUESTING A STUDY TO REVIEW THE
    FISCAL NEEDS OF THE STATE HIGHWAY FUND AND REPORT ON
    DEVELOPING A REVENUE PLAN FOR THE HIGHWAYS DIVISION.



 1      WHEREAS, the Department of Transportation, Highways Division
 2 will have transferred approximately $99,000,000 from the State
 3 Highway Fund to the General Fund from fiscal year 1995-1996 to fiscal
 4 year 1998-1999; and
 5 
 6      WHEREAS, the Highways Division has lengthened it's ten-year
 7 cycle road maintenance resurfacing program to a thirteen-year cycle
 8 program due to reductions in the maintenance program budget ; and
 9 
10      WHEREAS, State roads will continue to deteriorate and the costs
11 to maintain State roads will increase due to the lengthening of the
12 maintenance cycle; and
13 
14      WHEREAS, Hawaii's bridges are the second worst in the nation
15 with fifty-one percent of the bridges in the State of Hawaii in need
16 of repair or replacement because they are either structurally
17 deficient or functionally obsolete; and
18 
19      WHEREAS, with the federal Intermodal Surface Transportation
20 Efficiency Act(ISTEA) and the new Transportation Efficiency Act (TEA
21 21) programs, there are more agencies competing for limited federal
22 funds and the Highways Division is getting a smaller percentage of
23 federal dollars than in previous years; and
24 
25      WHEREAS, the Highways Division must maintain a sufficient fund
26 balance in the State Highway fund for cash flow purposes to provide
27 advance funding for the federal-aid reimbursement program; and
28 
29      WHEREAS, the last increase in the state liquid fuel tax, state
30 motor vehicle registration fee, and the state vehicle weight tax, and
31 the establishment of the rental motor vehicle and tour vehicle
32 surcharge tax occurred in 1991 under Act 263, Session Laws of Hawaii
33 1991; now, therefore

 1      BE IT RESOLVED by the Senate of the Twentieth Legislature of the
 2 State of Hawaii, Regular Session of 1999, the House of
 3 Representatives concurring, that the Department of Transportation is
 4 requested to convene a Task Force to review the fiscal needs of the
 5 state highway fund relative to its ability to meet planned operating
 6 and capital improvement expenditure requirements; and to develop a
 7 revue plan that will maintain the solvency of the fund through the
 8 six-year planning period in an efficient and equitable manner; and
 9 
10      BE IT FURTHER RESOLVED that the Task Force shall include the
11 Director of Transportation as chair; the President of the Hawaii
12 Automotive Retail Gasoline Dealers Association; the Chair of OMPO's
13 Citizen Advisory Commission; the Managing Director of the Hawaii
14 Transportation Association; the Director of Department of Taxation;
15 the Executive Director of the Tax Foundation of Hawaii; the
16 Chairperson of the House of Representatives Committee on
17 Transportation; the Vice-President and Chief Economist of the Bank of
18 Hawaii; the President of the Chamber of Commerce of Hawaii; the
19 Chairperson of the Senate Committee on Transportation and
20 Intergovernmental Affairs; the Chairperson of the Commission on
21 Transportation; the Chairperson of the House of Representatives
22 Committee on Finance; the Director of the Department of Budget and
23 Finance; the Executive Director of the Construction Industry
24 Legislative Organization; the Director of Business, Economic
25 Development and Tourism; and the Co-Chairs of the Senate Ways and
26 Means Committee; and
27 
28      BE IT FURTHER RESOLVED that the Task Force submit its findings,
29 report and recommendations twenty days prior to the convening of the
30 Twentieth Legislature, Regular Session of 2000; and
31 
32      BE IT FURTHER RESOLVED that a certified copy of this resolution
33 be transmitted to the Director of Transportation, the President of
34 the Hawaii automotive Retail Gasoline Dealers Association, the Chair
35 of OMPO's Citizen Advisory Commission, the Managing Director of the
36 Hawaii Transportation Association, the Director of Department of
37 taxation, the Executive director of the Tax Foundation of Hawaii, the
38 Chairperson of the House of Representatives Committee on
39 Transportation, the Vice-President and Chief Economist of the Bank of
40 Hawaii, the President of the Chamber of Commerce of Hawaii, the
41 Chairperson of the Senate Committee on Transportation and
42 Intergovernmental Affairs, the Chairperson of the Commission on
43 Transportation, the Chairperson of the House of Representatives
44 Committee on Finance, the Director of the Department of Budget and
