                    SENATE  RESOLUTION


  ESTABLISHING POLICIES FOR THE LEGISLATIVE BROADCAST PROGRAM'S
    CABLECASTS OF SENATE PROCEEDINGS. 


 1        WHEREAS, the Legislative Broadcast Project began
 2   cablecasting Senate proceedings on a pilot basis in 1994, and
 3   has been renewed every session since then; and 
 4   
 5        WHEREAS, the Legislative Broadcast Project produces live
 6   and tape-delayed video broadcasts of selected legislative
 7   proceedings for cablecasting on public access channels; and
 8   
 9        WHEREAS, the Legislative Broadcast Project is intended to
10   increase public access to and participation in the legislative
11   process; and
12   
13        WHEREAS, 'Olelo:  The Corporation for Community Television
14   continues to provide the Legislature with invaluable technical
15   and engineering support, programming time for cablecasts,
16   broadcast production television equipment and preventive
17   maintenance, repair, and replacement as needed; and
18   
19        WHEREAS, a private broadcast production company is
20   currently contracted by the Legislature to produce broadcasts
21   of legislative proceedings; and
22   
23        WHEREAS, the Legislature, through the passage of Act 373,
24   Session Laws of Hawaii 1997, established in statute, Chapter
25   21G, the Legislative Broadcast Program; and
26   
27        WHEREAS, the purpose of this Resolution is to establish
28   policies governing Senate participation in the Legislative
29   Broadcast Project; now, therefore,
30   
31        BE IT RESOLVED by the Senate of the Twentieth Legislature
32   of the State of Hawaii, Regular Session of 1999, that the
33   following policies shall govern the activities of the
34   Legislative Broadcast Project as it pertains to the Senate:
35   
36        (1)  Project Responsibility.  The content, selection, and

 1             editorial policies shall be administered by the
 2             President of the Senate.  'Olelo:  The Corporation
 3             for Community Television shall provide technical and
 4             engineering support, programming time for cablecasts,
 5             broadcast production television equipment, and
 6             preventive maintenance, repair, and replacement as
 7             needed;
 8   
 9        (2)  Distribution.  Cablecast programming coverage shall
10             be provided by 'Olelo:  The Corporation for Community
11             Television on O'ahu; and, via the Hawai'i Interactive
12             Television System, by Akaku:  Maui Community
13             Television on Maui, Moloka'i, and Lana'i; by Ho'ike:
14             Kaua'i Community Television on Kaua'i; and by Na Leo
15             'O Hawai'i:  Hawai'i Community Television on Hawai'i.
16             All bonafide news organizations and educational
17             institutions shall be authorized to utilize the
18             programming material and shall bear costs associated
19             with such programming.  Political or commercial uses
20             of the material are prohibited;
21   
22        (3)  Programming Content.  Programming shall include live
23             cablecasts on O'ahu and tape-delayed cablecasts
24             statewide.  All public committee hearings,
25             legislative sessions, and other legislative
26             proceedings shall be authorized for programming and
27             selected by the Public Access Room Coordinator based
28             upon the criteria of public interest and
29             newsworthiness, as measured by column-inches in
30             statewide newspapers and minutes of television news
31             coverage.  The President of the Senate may authorize
32             special programming in consultation with the Majority
33             Leader and Minority Leader.  Programming material
34             shall not be used for political or commercial
35             purposes;

37        (4)  Editing.  Cablecasts of legislative proceedings shall
38             be covered gavel-to-gavel, and shall include coverage
39             of the speaker recognized by the chair or presiding
40             officer.  Occasional shots of the entire committee or
41             assembled body shall be allowed; however, close-up
42             "reaction" shots shall not be permitted; and

 2        (5)  Ownership and Use of Programming.  Tapes and
 3             cablecasts shall be considered property of the
 4             Legislature.  Tapes and cablecasts shall not be
 5             considered an official record of the meeting, and
 6             there shall be no liability for inadvertent erasure
 7             or omission.  Tapes of proceedings shall be retained
 8             only for a period of time necessary to ensure
 9             rebroadcasts on neighbor island cable systems, and
10             for use in program evaluation and staff training.
11             Duplication or further distribution of tapes or
12             cablecasts shall not be permitted;

16        BE IT FURTHER RESOLVED that certified copies of this
17   Resolution be transmitted to 'Olelo:  The Corporation for
18   Community Television, Akaku:  Maui Community Television,
19   Ho'ike:  Kaua'i Community Television, Na Leo 'O Hawai'i:
20   Hawai'i Community Television, the University of Hawai'i's
21   Hawai'i Interactive Television System (HITS), Jones Spacelink,
22   Sun Cablevision, Kamehameha Cable, Hawaiian Cablevision,
23   Chronicle Cablevision, Oceanic Cablevision, Garden Isle
24   Cablevision, and Kaua'i Cablevision.
