Sir:

     Your Committee on Labor and Environment, to which was
referred H.B. No. 102, H.D. 2, entitled: 

     "A BILL FOR AN ACT RELATING TO WAGE PAYMENTS,"

begs leave to report as follows:

     The purpose of this measure is to eliminate the ambiguity in
penalties assessed against employers who fail to pay wages.

     Specifically, the measure establishes that the penalties
assessed shall be in amounts equal to unpaid wages.

     Testimony in support of this measure was presented by the
Department of Labor and Industrial Relations.  Testimony
supporting the measure with amendments was received from Consumer
Lawyers of Hawaii and the National Employment Lawyers
Association.

     Your Committee finds that the amendments proposed in this
measure clarify the original intent of the law that the amount of
the penalty assessed against an employer who fails to pay wages
in a timely manner should be equal to the amount of unpaid wages
and interest of six per cent.

     As affirmed by the record of votes of the members of your
Committee on Labor and Environment that is attached to this
report, your Committee is in accord with the intent and purpose
of H.B. No. 102, H.D. 2, and recommends that it pass Second
Reading and be placed on the calendar for Third Reading.
