Sir:
     Your Committee on Judiciary and Hawaiian Affairs, to which
was referred S.B. No. 798, S.D. 2, H.D. 1, entitled: 

     "A BILL FOR AN ACT RELATING TO NOISE,"

begs leave to report as follows:

     The purpose of this bill as received is to clarify state and
county jurisdiction over noise control, including noise issues
regarding the Convention Center.

     Testimony in support of this bill was received from the
State Convention Center Authority, the Department of Health,
Yacht Harbor Towers, and the Hawaii Agricultural Research Center.
Testimony in opposition to this bill was received from the
Neighbors of the Ala Wai and a concerned individual.  Testimony
commenting on this bill was received from Hawaiian Electric
Company.

     Your Committee finds that the provisions of this bill will
promote efficient and uniform regulation of noise in this State.

     Your Committee has amended this bill by:

     1)   Adding a section regarding the purpose of this bill;

     2)   Clarifying that an ordinance inconsistent with any
          noise rule adopted by the Department of Health shall be
          ineffective to the extent of the inconsistency;

     3)   Clarifying that the regulation of noise which may
          constitute a public nuisance in the Convention Center
          District shall be regulated by the Department of
          Health; and

     4)   Making technical, nonsubstantive amendments for
          purposes of clarity and style.

     As affirmed by the record of votes of the members of your
Committee on Judiciary and Hawaiian Affairs that is attached to
this report, your Committee is in accord with the intent and
purpose of S.B. No. 798, S.D. 2, H.D. 1, as amended herein, and
recommends that it pass Third Reading in the form attached hereto
as S.B. No. 798, S.D. 2, H.D. 2.
