         DECISION MAKING ON THE FOLLOWING BILLS

SB 558        RELATING TO LAND USE                                 WLH, JDC
           Allows the land use commission to impose conditions
           on reclassified lands.    Allows  for citizen suits
           for  violations  of  the   State's  land  use  law.
           Strengthens penalties for violation of chapter 205,
           HRS.

SB 560        RELATING TO SPECIAL MANAGEMENT AREAS                      WLH
           Defines  "substantial   adverse   environmental  or
           ecological  effect"  as   it   relates  to  special
           management  areas  to  include  specific  levels of
           degradation or damage  to  resources  which is also
           defined.

SB 557        RELATING TO THE BOARD OF LAND AND NATURAL RESOURCES  WLH, JDC
           Allows a  simple  majority  of  the  members of the
           board of  land  and  natural  resources  present in
           order  to  take  action  on  conservation  district
           permits and site plans.

SB 559        RELATING TO PUBLIC ACCESS                                 WLH
           Establishes  the  public's   right  to  access  the
           State's recreational and cultural resources.

SB 68         RELATING TO PUBLIC LAND                              WLH, JDC
           Declares that  the  government  is  not  liable for
           accidents  and  injuries  occurring  on  unimproved
           public land.  Repeals Act 190, SLH 1996.

SB 226        RELATING TO PUBLIC LAND                              WLH, JDC
           Declares that  the  government  is  not  liable for
           accidents  and  injuries  occurring  on  unimproved
           public  property;  requires  the  state  or  county
           operating a public beach park develop and implement
           a   plan   for   warnings   of   dangerous  natural
           conditions; repeals Act 190, SLH 1996.

SB 965        RELATING TO LANDOWNERS' LIABILITY                    WLH, JDC

 
           Amends HRS  to  include  the  state,  any county or
           political subdivision of the State, or other public
           entity within the State,  as  owners not liable for
           recreational users of land.

SB 42         RELATING TO PUBLIC LAND LIABILITY IMMUNITY           WLH, JDC
           Requires the task force  on beach and water safety,
           under  Act  190,  SLH   1996,   to  report  to  the
           legislature before  every  regular session; repeals
           sunset date of Act 190.

SB 621        RELATING TO PUBLIC LAND LIABILITY IMMUNITY           WLH, JDC
           Declares that  the  government  is  not  liable for
           accidents  and  injuries  occurring  on  unimproved
           public  property;  requires  the  State  or  county
           operating a public beach park develop and implement

SB 622        RELATING TO LANDOWNERS' LIABILITY                    WLH, JDC
           Amends landowner liability  law  as to recreational
           use  to  clarify  purpose,  include  exceptions  to
           immunity in liability and  duty of care provisions,
           relieve landowner from  duty  to investigate risks,
           and make user liable  for  attorneys fees and court
           costs if landowner  is  found  not  liable under an
           exception to immunity.

SB 380        RELATING TO REAL PROPERTY                            WLH, JDC
           Amends Landowner Liability  Law  as to recreational
           use to clarify purpose and include state and county
           governments,  include  duty   of  care  provisions,
           relieve landowner from  duty  to investigate risks,
           and hold user liable  for  attorneys fees and court
           costs if  landowner  prevails  pursuant  to chapter
           520.

SB 1492       RELATING TO PUBLIC LAND LEASES                       WLH, WAM
           Allows  lessees  of   public   pland  to  sell  the
           improvements to  their  leased  public  land to the
           successor lessee.

SB 1080       RELATING TO PLANNING AND COMMUNITY DEVELOPMENT       WLH, WAM
           Allows the continuation  of  the  review of Kakaako
           waterfront development  applications  to facilitate
           development, create jobs, expand  the tax base, and
           generate revenues.

SB 1074       RELATING TO COMMUNITY DEVELOPMENT                    WLH, WAM
           Repeals the Hamakua  Development District which has
           since been superseded  by  subsequent activities in
           Hamakua.

SB 1068       RELATING TO THE REDEVELOPMENT OF BARBERS            WLHL, WAM

 
           POINT NAVAL AIR STATION
           Authorizes  the  Barbers  Point  Naval  Air Station
           Redevelopment   Commission   to   provide   utility
           services  for  property  conveyed  by  the  Navy to
           federal,  state,  and  county  agencies  under base
           realignment and closure and  to recoup the costs of
           these services  from  the  end  users.   Allows the
           Commission to establish advisory committees.

SB 1109       RELATING TO NOTICE OF BREACH OR DEFAULT              WLH, JDC
           Proposes  to  reduce  the  period  for  curing non-
           monetary defaults under leases and patents of state
           land  from  sixty   to   thirty  days,  subject  to
           necessary extension only  in  cases where required;
           permit the parties, by agreement, to give notice by
           facsimile.

SB 1098       RELATING TO THE STATE WATER CODE                          WLH
           Clarifies that  the  Commission  on Water Resources
           Management  has  exclusive  jurisdiction  and final
           authority in matters relating to the code.


SB 1094       RELATING TO THE SPECIAL LAND AND DEVELOPMENT FUND    WLH, WAM
           Authorizes the deposit  of  fees,  fines, and other
           administrative charges collected under chapter 171,
           into  the  Special   Land   and  Development  Fund.
           Expands  the   uses   of   the   Fund   subject  to
           authorization by the Legislature.

SB 1082       RELATING TO THE BUREAU OF CONVEYANCES                WLH, WAM
           Authorizes the deposit  of  a  portion of recording
           and  other  collected  fees   into  the  Bureau  of
           Conveyances  Special  Fund,   and  establishes  the
           Bureau of Conveyances Special Fund.

SB 978        RELATING TO THE FOREST STEWARDSHIP PROGRAM           WLH, WAM
           Amends  definition   of   "potential  natural  area
           reserve"  in  the  forest  stewardshiop  program of
           DLNR.
