DESCRIPTION:
Allows a retired ERS member who was on temporary loan to the
civilian defense agency in 1942 for fingerprint classification to
buy back membership service credit at the rate of compensation

                   A  BILL  FOR  AN  ACT

RELATING TO BUYBACK OF EMPLOYEES' RETIREMENT SYSTEM MEMBERSHIP
   SERVICE CREDIT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that during the war years,
 
 2 when a degree of uncertainty and confusion occurred in Hawaii,
 
 3 there were some individuals who, while employed by the State of
 
 4 Hawaii, were temporarily hired or on loan to other agencies such
 
 5 as the Civilian Defense Agency to help in fingerprint
 
 6 classification.  After returning to their regular jobs after
 
 7 eight months in the temporary assignment, these employees were
 
 8 given the opportunity to buy back these months for credited
 
 9 service in the employees' retirement system.  This opportunity
 
10 was repealed after some time, but the legislature finds that
 
11 there were some employees who were not adequately informed of
 
12 this right.  As a consequence, when these individuals retired,
 
13 they received less credited time and hence, less retirement
 
14 benefits.  The purpose of this Act is to help rectify the
 
15 situation for these individuals to allow them to buy back their
 
16 lost months of temporary hire when it occurred during the war
 
17 years.

 1      SECTION 2.  Any retired member who had at least thirty
 
 2 years of credited service in the system, whose services were on
 
 3 loan to another government during 1942 for purposes of civil
 
 4 defense fingerprint identification may be credited with
 
 5 membership service credit if purchased at the member's last
 
 6 compensation level at the rate specified in section 88-45, Hawaii
 
 7 Revised Statutes, and before December 31, 1998.
 
 8      SECTION 3.  This Act shall take effect upon its approval.
